Pending I-130 (CR-1)
Hi, for the pending I-130 (CR-1) spouse living abroad, what tax filing status we should use until spouse is in the US?
Please share your insights if you have filed taxes recently in this scenario.
Also, anyone got approved recently for Dec 2023 filed dates?

(Copied from IRS.gov) WHEN A U.S. CITIZEN OR RESIDENT ALIEN IS MARRIED TO A NONRESIDENT ALIEN, THEIR FEDERAL TAX FILING STATUS IS MARRIED FILING SEPARATELY. HOWEVER, YOU MAY CHOOSE ANOTHER FILING STATUS IF YOU QUALIFY.
ONE OPTION IS THAT BOTH YOU AND YOUR SPOUSE CAN CHOOSE TO TREAT THE NONRESIDENT ALIEN SPOUSE AS A U.S. RESIDENT FOR TAX PURPOSES.
IF YOU MAKE THIS CHOICE, YOUR FILING STATUS IS MARRIED FILING JOINTLY.
IT’S IMPORTANT TO UNDERSTAND THAT MAKING THIS CHOICE DOESN’T CHANGE YOUR SPOUSE’S U.S. IMMIGRATION STATUS.

what I did is file separately and mail in my tax form with my wife’s SSN as NRA (non-resident alien). unfortunately most services won’t allow you to submit online without a tax number for your spouse

@Joseph Smith out of curiosity: how was it possible for your wife to get a SSN? we were told it is not possible until I live in the states and have my GC

The non-resident alien spouse will need to apply for ITIN number as they can’t qualify for SSN. I’m also in the same process

@Joseph Smith after you wrote NRA, did the filing go through? did you have to amend your taxes afterwards?
