passport renewal with asylum pending
hello! I had pending asylum case and filed AOS based on a marriage.
my home country passport expired and the only way to renew it is to go to the embassy. which is considered as returning to your home country. I know with asylum pending it’s not a good idea. but is it different if I have marriage based case pending?

Since you’re adjusting status through marriage, you can withdraw your asylum case as soon as you get your GC and eventually renew your passport without any issues. In the future, if you’re planning on becoming a US citizen, your entire file would be assessed and you might have to give some details on why you renewed your passport. Hope it helps!

yes I understand that. the question is about renewal while GC is still pending.

they gonna renew your passport , you need to attach I485 AOS reciept notice and (maybe marraige certificate) this is what I have heard.

I would wait, but if you need to renew it, you can definetely do it! It wouldn’t affect your current AOS process through marriage :)

go to your home country embassy in the US, they should be able to renew your Passport. Most are in DC or New York. Do not exit the US though.

I have friend who had a marriage based interview, and during interview officer asked was the asylum case closed. since it wasn’t close the interview was rescheduled. and then covid showed up. so his interview was rescheduled 4 times already. hope your GC will be approved . talk to a lawyer about that

that’s so crazy. I read that lawyers don’t recommend to withdraw the asylum case until you get your marriage based GC.

my home country not even allowed to renew passport from the usa😂 they say, if you want to renew your passport go back😂 so i dont have passport. it expired 😂

country called Kazakhstan. there are 2 consulates and 1 embassy in the US. but the country doesn’t support its citizens
