Per new NTA memo signed 7-8 days ago, does anyone who gets denied for Vawa gets NTA?

my lawyer sent me this. USCIS may issue an NTA (Notice to Appear) in the following cases: • Denial of permanent residence (Green Card) applications, including those based on family petitions, employment, or other immigration benefits. • Voluntary withdrawal of an application before USCIS makes a decision, which could be interpreted as abandonment of the case and result in the issuance of an NTA. • Fraud or false statements in any immigration application, including incorrect information, altered documentation, or misleading statements. • Illegal presence before submitting the application, meaning that if USCIS determines that a person has accumulated unlawful presence before applying for an immigration benefit, they may be referred to court. • Certain criminal records: Even if the applicant has already fulfilled all legal consequences, USCIS will assess whether their criminal history makes them inadmissible or deportable. • Asylum and TPS cases, where if the application is denied or voluntarily withdrawn, the applicant may receive an NTA and be placed in removal proceedings. hope it helps.

@simon irfan bro!! I just read about this update, all I can say is we are in a scary time.. may God help us. so basically, any denial now will mostly attract a NTA except some rare cases. It looks like nothing new tho, but I think it was supressed under Biden. My advice is people should file properly and follow-up/monitor their cases well, if you send rfe’s.. ensure they are well delivered cos NTA is not a joke🙏🏽

if someone denied they wont even gave a 30 days to chance to maybe refill ? is that what changed?
