Need advise🙏
hello everyone!!
I am F1 student and currently in OPT and doing my job. my Opt will expire on May 2022. I m waiting to get my EAD through eb3 process since June 2021. after couple of months, my opt will expire and I am worrying about my status. I don’t want to join collge for master right now. so I decided to join community collge for associate degree. I am stepping down from bachelor to associate just to maintain my status until I will get EAD approved.
so my concern is, is it possible or legal to stepped down from bachelor to associate? I can join community collge for associate degree?
please advise and I really need help. thanks in advance 🙏🙏🙏

i current opt is ending this month and i submitted i-485 in dec 2021 so my lawyer told me i do not have to go back to school. it okay not to go to school while pending i-485. you should discuss with lawyer!

no need to worry about your satus in USA until uscus makes a decision on your case. you should be more concerned about your employment as your opt is going to expires in a few months. For school, the immigration will not ask you for your school because they mainly focus on your visa status at the time of you submitted your 485 application.

@omo B. what is if my case will deny if don’t maintain my status till then. I heard that what u hv said that I don’t hv to go back to schools since I-485 is pending. I will be in status. but I am just worried incase that happen, then I should hv back ups. that is why I decided to join the associate till then just to maintain my status until my case approves

@Tedday, I am just thinking about the back up. I hv heard that one of my friend had the same situation and his lawyer said him the same things while I-485 is pending, don’t hv to worry about to go school n maintain status. so he didn’t join school but later for some reason his I-485 got deny and he was out of status. so I m just worried u know incase that happen to me. I should hv back up. going to master program is expensive and tired of spending money on education. so I was just thinking what if I can downgrade my education to associate. please advise 🙏🙏🙏

I B don't go to school reason
1. you don't have to like others mention (pending i485)
2. if you go you'll get new i20 but you applied for AOS based on what you have in your hand

what I would recommend since you really want a back up just get the whole process ready for applying to whatever you want but don't execute it until you hear back about your AOS

@w k. thank u so much for ur comments frend. so I am gonna do now? opt is ending soon, n yesterday I got an email saying that,my employer is changing to different company now. good thing is, I don’t hv to start over my process from the beginning but bad things is, there is another delay in my case. opt ends on May, n I don’t know what to do? after opt ends n if I don’t get EAD from my employer, then what I am supposed to do to maintain my status.

and that is why I am looking for college to join just to maintain my stupid until I will not hear anything from my case. I am really in frustration right now 😞😞

wait so here I think you should do this. get admission in college and do get i20 or anything be like I want to kick off the process for now andake you get accepted and all be like I'll start next semester this way you got everything lined up and if you need this backup use it at that time
