CASE DENIED!! My i485 Denied based on the denied i140 instead of the approved - any one with experience?
l left my first job after 18months waiting for i140 and i485 to be approved.
My second employer filed a new i40 which was approved early this year.
My attorney wrote and requested uscis to link old i485 to approved i140 which was agreed and confirmed via phone since uscis does not respond to such request.
5months after confirming the link, the old i140 was denied.
Then last week my i485 was denied based on the old denied i140.
What are my options - can l still work, do l need to leave the country and wait for my i485 outside USA?
l am a healthcare worker.

you need file MTR with all new information or you can re file I485 with approved i140

What are my chances of being able to get it opened - if not what would they refuse to reopen case and link my old i485 to approved i140?
Do l have to leave the country to file another i485?

Don’t leave until you fix the problem your attorney can submit the MTR & they can refile I485

My attorney is saying that of we don't hear with 3-4months we have to leave and apply i485 from my home country and its not making sense?

at this point in time, you want an option which will have you stay in the US while the new paperwork is processing. from my understanding, your current attorney is suggesting for you to return to your home country which looks like something you are not ready to do. I'll suggest you consult with another attorney and see all the options available for you. Also, in this process, you are free to change and switch attorneys however you deemed fit. you are not stuck with one particular lawyer for the entire process and USCIS knows this. best of luck!! and please let us know the outcome!!

in additionally you can file a new i485 I have gone through all the above procedures my I 485 denied on September we filed MTR with all new evidence i485 re opened in 38days

you should deal with good attorney while doing the MTR. please do not exit until you fix this you can’t file I485 once you exit from US

Sorry to hear that - when EB2 was denied you filed EB3,, did you leave the country or you are still in the usa?

still in the US…the main problem is according to the IO we already accumulated unlawful presence since our first I-485 was denied. The good thing was after the interview the IO didn’t deny us yet. He said he will send a letter to our lawyer explaining the gaps and late filing. It’s been a month now since then… still waiting 🙏🙏🙏
