you can file concurrently but i131 will be denied except your removal proceedings has been dismissed.

@Tony M i also file for dismiss my removal proceeding its almost 9 monthes no response yet and my final date in april this year

me. my lawyer have to temporarily close on removal to get EAD now I have to wait until I360 approval then I can close the removal permanently before they can adjust my i485

@mm AA Then I think the reason on being on removal proceedings matters. I consulted a lawyer today and she also said if you are on removal proceedings and had either vawa or i130 pending. either one of them had to be approve . Then dismiss your case at court with the approval before applying for adjustment of status . So I don’t understand how my friend @Tony M and @mm AA be able to have adjustment of status with USCIS when they on removal proceedings.

@hope waiting ,you can file joint motion to dismiss the removal proceedings. my attorney did filed and I attached a lot of documents and it was dismissed.

@mm AA you cannot just a file for a join motion that’s why you wait for i360 or i130 to be approve . so you can you the approval to apply for a joint motion.

@hope waiting my i360 isn’t approved yet and my removal proceeding has been dismissed since Jan 2023.

@mm AA congrats 🎈 I tried to dismiss mine and its was rejected by DhS . now I have no choice but to wait for my vawa to be approve before applying for adjustment There are several ways cases can be dismissed by DHS. Some would be able to dismiss by using premier facie or approv i130 and much more . People have different cases and different reasons to be on removal proceedings.

@mm AA this debate started on my profile timeline. maybe you did not have the chance to read that . my argument was if you are on removal proceedings USCIS will not accept your adjustment of status unless if you are able to dismiss you removal case or have an approve vawa or 130 or other benefits. I’m not a lawyer so I don’t know why other on removal proceedings where able to have their adjustment with USCIS. I guess every case is different

@hope waiting my i485 was accepted even before the dismissal of my removal proceedings. don’t know Y. but I have pending i485 and i360 since 2020 and motion was dismissed Jan 2023 while both cases are still pending

DOJ updated its regulations in July 2024, empowering IJ to dismiss cases if the noncitizen has a prima facie case with USCIS. My removal proceedings were dismissed on Dec 4 based on the I-360 prima facie determination, and I applied for I-485 in late December. When you are in removal proceedings, the adjustment of status is within the immigration judge’s jurisdiction. If you file it with USCIS and your removal proceedings are still ongoing, it will be denied once your I-360 is approved.

if your i360 is approved while in removal proceedings, uscis will close your i485 administrative. they won't deny it, they want you to cancel removal proceedings and your case with uscis can be open and you get your i485 approved.
