it's been 9 months since I submitted response to NOID
I am just here lost and imagining what could be wrong with my case. over 18 months since interview and over 9 months since I responded to NOID. Can someone here help me brighten my day. It seem like I am in a deep darkness and I feel lost. and now I am expecting a child I don't know how to plan her future. What a ruthless life.

@Rocco Forte so has anyone been approved in that situation? I’ve been denied, refiled and nothing still. Even the denial was overturned but it’s taking forever

No it doesn’t. it just gives you a verifiable divorce decree. The reason they are giving you grief is because you divorce from nigeria cannot be verified to be authentic. Other people also suggest getting an independent lawyer in nigeria to go to the courts to verify your divorce then swear an affidavit saying your divorce is real

Wow, so say I go the first route with a new divorce decree from here - do I withdraw my two cases both the appealed and new case and then refile a brand new case the third time? or go the second route and send the affidavit unsolicited? sorry I’m asking so many questions but I’ve been on it since 2019 @Rocco

Appealing without changing the reason the case was denied in the first place is a waste of time. You need to fix the reason why the case was denied in the first place then refile

But that’s the funny thing, they have never at any point referenced my divorce, it was never mentioned in the denial, my new case they asked about my prior marriage during the interview but that was it, nothing more.

Just said we didn’t give enough evidence for bonafide marriage. it was during the last administration so it did not come as a surprise

Omo men this divorce wahala from Nigeria is too much this shit mess peoples life up here I almost run mad because of this divorce issue guys look the best thing to do is to do a new divorce from here and start all over again don’t wast your time to appeal. it’s the best way. sad to see people go through this very sad 😞.

@Bolanle the idea is to sit on your case till your marriage here falls apart so they can deny your case and put you in removal

@Bolanle it’s sad what they do, that’s why you have to be very proactive while dealing with them. Don’t leave anything to chance. Did you file your case with a lawyer?

There is an inadmissible issue here (Fraud and Misrepresentatio).. The only way you can overcome this is through a waiver. Your spouse should shows extreme hardship if you relocate to your home country. I do belive they are sending someone to Nigeria to chek the divorce certificate/degree you submitted is genuine, that why they stay silent.

So long story short, NOID said divorce decree looks like fraud, mentioned few discrepancies from interview, address history discrepancy as well. Lawyer said try to get a rectified copy of divorce decree from the Nigerian court, get support letter from families and friends, get other evidences of established relationship between myself and my wife. I printed our conversations from the first day in 2018, printed pictures of our diseased baby, printed utility bill and other stuffs.

Whatever happen, don't leave USA. After all it will go down to your spouse. The worst case is to demonstrate return to Nigeria will lead to the extreme hardship .And if your divorce is real and happens before you married your current spouse no need to worry, they will find out. And offcourse you are going to be blessed.

@Rocco I understand that. I have been here for 5 years now and I havent made any progress, other people around me are moving, they are doing great things, but I am stuck, I feel like I'm imprisoned. And how do I know what to fix If I don't know where I stand, at least they will send denial or whatever before I will know what I am fixing.

or me they didn’t say any after interview for 3 years until I and my wife now get a lawyer that help us to sue them they now respond within a month with NOID. for 3 years they keep telling me that i am on extended review when I call them, we even ask for help from senator, senator also got back to us with the same result and tell use that our case is on extend review. as Bolanle said they will just wait for your marriage to fall apart they will delay you and that will also have a negative impact on your marriage for someone like me also have a child in my marriage that I didn’t know if I will be able to remain in the country to take care of her or not at least I deserve to know what is going on with my case but this people are very different they will keep you in darkness and your life will be messed up it will be put in a position that you don’t even know what to do with your life I wish we have good security in Nigeria because I wanna take my wife and my daughter back to my country it’s a shame on Nigeria government not everyone wanna go through this. Very sad situation and the crazy thing is that if uscis have a problem with divorce document it’s much better for them to send a NOID on time so that you can know what to do with your life instead of the delay. The delay thing is a brain damage and life waster: very sad for anyone to go through that.

@Hopefully I swear it is not worth it. I came in when I was 29, now I am 34 with no progress. I have to work 3× harder to support my family here and my relations in Nigeria, because I can't go to school. Life is in fact harder here than in Nigeria, Because I am living in a country where I am not free.

@ola I understand you and I feel your pain Most people are here because they have to be here not because they want to be here most especially the highly educated ones from Nigeria that supposed to remain in the country to work and support the system but they leave or remain here because they don’t feel in the safe in the country and on everything you do in life as a human being safety comes first most people wanna safe them selfs and their love ones it’s all about survival and they go through extreme hardship and depression for a piece of paper called green card. it’s not a big deal to marry from here and your spouse should also be able to move in with you your own country but in our case we Nigerian are always the one to move out because of stupid leadership of Nigeria

@Bolanle why would the lawyer suggest a waiver? that’s admission of guilty. You only use waivers when you have been caught for misrep or something else bad.

@Ola , you can't go back because that is no option. Just pray and hope to God. I am in a similar situation too but I have not received any NOID. my case has been static and no response after my interview a year ago. I just sent a mail to my congressman to intervene and I got a response from the office that they are looking into it. I have made calls to USCIS and the only response I get is they are still reviewing my case. I actually applied for N400, I have my permanent residency and also have ended my relationship here. but my case was referring to my previous one in Nigeria. I am stuck too. All i can do is pray to God for divine intervention

@Angry Angy the US citizen is always the sponsor of the spouse. Others are joint sponsors. With than being said, look up the requirements of a sponsor on uscis website. A sponsor must be in a right frame of mind to sponsor a beneficiary. When I did my first interview, my US citizen wife had an anxiety attack few weeks before then, i took her to the ER and she was given antidepressants. She was still on the last dose when we went for interview, so she was kind of thrown off with remembering our old address. She told the IO that she was on medication thats the reason she forgets easily and little nervous. She asked for proof, we gave her the prescription cos I made a copy just in case. Immediately the officer said, i will have to bring you back then bcos you are not qualified to petition without the right frame of mind. At the second interview 8months later the first question was if she was still taking the medication and we said no, then the interview could proceed. Ask a good lawyer.

@jackson wahooo I did not know she was on medication. @Angry I pray we all hear good news soon . am from Nigeria never married before and my wife never married before and we still wating 14 month after second interview in dallas. so what can I say it just that am from Africa that why no criminal record clean record pay tax and still stock at review it so painful but just hope one day they would approve me . the officer told us 120 days after second interview and it 1 year and 2 month already and no age difference . the same age with my wife so it just the color and country that how it has always been . if I was from Norway or Germany I would have got my card long time ago. but I wish everyone good luck

@Booo Booo I think 14 months after your interview is more than enough time for them to investigate whatever. They are profiling you because you are Nigerian that’s all. If I were you will sue next month because they are seriously delaying your journey to citizenship. You could’ve been getting ready to removed conditions now

To everyone, please what do you all think I should do in my situation with NOID after almost 10 months. Because I feel like my life is falling apart now. Can I sue them as well? what is the worst case scenario if I sue them? Any idea on what I can do? or I should just keep waiting. It's been over 9 months after NOID and over 18 months after interview. please help me.

I never got NOID I had my stoke second interview since March last year in dallas and got new card yesterday and approved today . after 2 interview it was silient for 15 month
