Is it possible to request expedite of I485?
Hi All,
Our I485 is now 5 months past normal processing (Feb 2020) with I140’approved in September 2020. We have not been asked for medicals yet, but have completed them and are just waiting on the doctor completing the pack so they are ready to submit.
The EAD expired around 2 months ago and I’ve been on leave from work. I have tried four expedite requests to no avail.
Can we request expedite of the I485? Anyhting else anyone would suggest?
I plan on requesting support from a congressman this week.

No, it’s employment based so most are being skipped and going straight to appproval after medicals.

I’m in the same boat. I had my i140 approved Aug 5, 2021. My EAD expired in Dec (a renewal was done in Sep) and I am now in 180 days. Neither received any updates to i485 (medical RFE) nor the new EAD. It’s suck bc I have a permanent position.

the I-485 will not update quickly after the I-140 approval. Some guys think due to the concurrent filling it should be right away. It should in my opinion… anyway, some cases are faster than others, it all depends on the officer handling your case. My I-140 was approved in May 2021 (EB2-NIW), I-485 RFE issued on Nov 2021, basically 6 months after 140 approval. RFE was sent to USCIS in December and now I’m still waiting for the approval. it’s now almost 9 months after the I-140 approval. i believe the wait is long for most of us. rare cases are very fast.

expediting the I485 is very difficult unless you have a very good reason (huge than the EAD expedite requests). What I did (AND I DONT KNOW IF IT IS RELATED) was send the EAD renewal way before the expiration (to see if they decide to move the I-485 instead of handling the EAD). I sent the EAD renewal in October 2021 (the expiration is May 2022). I-485 was touched on Nov2021 for RFE.
It can be a coincidence, I really don’t know, it's worth trying. In theory, it is not necessary to renew my EAD since its expiration date is in May 2022 and it’s very likely that the green card is approved in the meantime.
What I will do if the GC is not issued by March, I’ll request expedite for EAD expecting an update in the I-485 since they already have 100% of what they need for the approval.
everything is just theory ok. it worked for me, coincidentally or not.

i understand that your case is taking too long since the dates you provided are from 2020.
Inquire about your case being outside processing time is the first option. you have the lawful right of an update.
my experience is being based on a regular processing time.

I had my i485 sent together the other forms in Jan 4, 2019. I believe - seeing other experiences like yours, @R C, that when the i485 is issued after the i140 approval, it is faster. Also, I believe you will receive your GC soon as you have already sent the RFE medical.

My processing center is in Texas.
Also, they sent my I-140 approved case for Embassy processing after approval. A clear error because I’m in the US. I received an email with all instructions to go the my country embassy and move forward with the I-485… That was scary a bit.
My attorney called them to fix the issue. The 140 case is still there and they said there’s no problem since my I-485 is in Texas and they will process it.

my PD for I-485 is April 2018. my I-140 was approved Aug 2020. I received medicals RFE Nov 2021. still waiting. already requested the out of processing 2 times. both I received generic answers

Ed D, is your process in Texas? at least you already received the medical REF. generally it takes 3 months after it. Hope u get it soon.
