Is it okay a US citizen spouse moves back to the US first before I(beneficiary) receive the GC/before the interview(I-130 submitted abroad)?
So the situation we have here is.. my US citizen husband quit his job recently to change his career and doing freelance jobs for now. And we are living together outside of the US. We submitted I-130 form here almost a year ago and it hasn’t been approved yet. Would be nice that we go to the states together after I get the GC but seems it’s going to take longer than we expected. So my questions are : 1) Is it okay that my husband not attend at the interview? 2) Is it going to affect our case if he moves back to the US before I receive the green card? We are considering that my husband could go to the states first and get set up..

I don't have an answer but will also be moving back to the US ahead of my husband for work. hopefully someone has some answers but as far as I know there shouldn't be any problems. I don't think the citizen has to be at the interview.

@Nicole Lou Thanks for sharing! when i found info about the interview on the internet it was all over the place. Hope you and your husband case goes through quick too. When did you guys submot i-130? hasnt been approved yet either?

thanks...it's a longggg wait 🥲 can I ask which country you are from? we've applied from Spain. PD Oct 3 2021, active review since April. Potomac center. which center are you at? hoping for any day now. a bit nervous about moving back ahead now, might consult a lawyer. if so will let you know!

@Nicole Lou ah your case is really similar to ours applied from South Korea PD : Sep 29th 2021 Active Review : March 22nd 2022 Seems our case was transferred from Nebraska center to Potomac center. Still not 100 percent sure about it tho. we got receipt letter from Nebraska center but when we sent a message on USCIS website they said select the Potomac center to check the timeline. Hope both of us can hear from potomac center soooon. it is exhausting 😭 please update your case for me if you dont mind. ill be interested in knowing how your case goes.

same happened to us with nebraska to Potomac 🥲 its truly exhausting. manifesting a positive response for us both soon 🤞🏻

How did you figure out that your case is transferred? did you get the notice or through Emma? we didnt get any transfer notice.

didn't get any notice either. had to talk to a live agent through emma. I didn't even think to check on it til I downloaded lawfully and entered my case number and it showed up as being in potomac. also after a bunch of research it's totally fine that the US citizen spouse goes back ahead! citizens are not required to be at the interview for consular processing.

Oh i see. haha same here. that’s why i double chekced on the USCIS website where my case is at. thanks a lot for sharing the info! :) yea i researched more too and seems it’s fine without the US citizen spouse! Good luck on going back to the states and hopefully can hear good news about the green card from you later :) !
