go for a writ mandamus… otherwise you could wait for years, I did mine on July last year and got the approval in 60 days.

Hey PB if we do a writ of Mandamus before the processing time which is now 5 years is that ok? Just hoping they wont come back with saying thats its still within the processing time and to simply keep waiting - your thoughts?

Anand, you can start the WM wherever you like, it’s actually a lawsuit before a federal court. remember is a judge who makes the decision not USCIS. I did mine when my case was 18 months, after filling it took less than two months to have my new unconditional GC’s at home. Keep in mind that theoretically USCIS should be giving you a response on a I-829 in 90 days… the average time they take to process a case has no legal basis according what lawyers told me.

Anand you are welcome. just as a comment I just started my N400 and seems moving really fast, filled on dec 29th, and yesterday had my biometrics taken.

hi. I am still waiting for my i829 approval (filed 12.12.2019). Since I live in USA for 5 years already I applied couple months ago for n400 (citizenship). I read that my n400 will not be approved until my i829 is approved. But today I received the date of my interview for n400. how it is possible?

I also heard that the N400 goes into hold till the moment you get the removal of condition, this was one reason I did the writ mandamus and on April 14th got my naturalization certificate 😎
