i751
hi all, question about the i751, we filed on nov 2021 and it’s still pending. now we about to file for a divorce. should I send to USCIS asking to switch my case to a waiver? why would I do this now and not wait, maybe case will be approved before the divorce is finalized? divorce in California takes about 6 months

Finalize your divorce and send in the certified divorce decree and a letter requesting to be converted to divorce waiver

thanks. what happens if it gets approved before divorce is finalized? will I have an issue later on for the n400 citizenship?

you will have to wait 5yrs to file for citizenship rather than the 3yrs when still married

thank you. but USCIS wouldn’t complaint if I don’t notify them of divorce? they will def see that when I apply for citizenship 5 years later that I got divorced before i751 finalized

If you get approved before divorce is finanlized you might face challenges later because you should’ve notified them once your divorce was filed

you should notify them that you have filed for divorce. They will probably put your case on hold until your divorce is finalized.

out of curiosity. so we have to notify them twice? once we filed for divorce and after the divorce is finalized?

You said you were about to file for a divorce. if you have not done it yet, I would advice you to wait. if not, you will have to prove the marriage was bone fide. Meaning real intent to stay married but could not happen because of whatever reasons your lawyer judges best

@S T thank you for the advice. ya I did everything I can. I gotta respect her wishes too. unfourtenatly ya I think it will be tough but we have been married for a long time and i751 been delayed. so hopefully they won’t be too sticklers with me

it’s best if you notify them about the divorce evening you haven’t gotten the GC. I’m going to the same process and almost ready to send for the waiver. best of luck you all of us
