I need some advice
Hello everyone, I need to some advice because I'm not sure if my lawyer is handling my case right. I came when I was 17 yrs old with a tourist Visa, and my dad was able to submit a petition for me, but I was already over 21 yrs old.. I have the I-130 approved and my priority date is ready. My lawyer said that I have to go to my country for my interview. In order to do so, I needed to submit the I-601A and have it approve before going to my country for the interview. I’m in a similar situation and this sounds right. I got my 130, 601a approved, and now I’m going through the consular process (which has to happen outside the country)

i submitted my application (DS-260) December 28th so I’m hoping to hear from them soon. Also, I am working with a lawyer. My suggestion would be to work on the DS-260 application as you wait for the waiver to be approved so that the transition is smoother/faster

that would be great, but what if they schedule on interwiew before i601a aproved ? tgats kind a tricky becouse noone kno when they will aprove waiwer

They won’t schedule it before. If your case is like mine, you need to have your waiver approved before you deal with the NVC.

@jess washere that's what they told me, that I need to have the waiver approve before scheduling the appointment with NVC. does it make any difference that I have Daca?

@S4br!n4 M. Yes that’s true! I meant you can prepare/fill out/have the information ready for the application before the waiver and be ready to submit it right after the approval of the waiver. I honestly have no idea how Daca affects the case. I wish I could help

I don’t think so you’re dealing with a good lawyer! as long as you came through a legal visa, u don’t need to go back home country for reenter USA. u got your i-94
