I AM HERE TO HELP
Hi folks,
My VAWA case is approved. I went through a lot, long waiting, lately sleepless nights, frequent follow-ups with my attorney, USCIS and was about to ask for a help at my Congressional office and ombudsman.
Got a quite bit of experience. If you need any help, I am here to answer the questions. I just wanted to share my story and experience with yāall who have been waiting. There is a bright light at the end of the tunner, just be patient.

when I applied timeline was 24 month, after a year of applying it turns to 33 so what is applicable on me 24 or 33.
also is prima facie have any impact? did it means if it expired that the person will hear a new, Also is 130 denied is that an issue ?
also have you used your PF if yes on what ! can I use it on school

The USCIS sent me a request to provide more evidence I could not send more evidence because two weeks after my marriage, I closed everything because of Corona All I have are pictures with my wife, the marriage contract, the report of psychologist , and threatening letters. What can I do and what are my chances thank you

@moe sh Write a detailed explaination of what happened that you guys donāt have proof of share residency together and everything that caused delay with your unable to provided the needed evidence if possible with date and time then notarize it and send it with what youāve sent before

@Arsenal Fan I had marriage before. Right before filing VAWA, I took a divorce. You can file VAWA within 2 years from Divorce, not later.

@haj 97 Unfortunately new timeline will apply. Itās increasing and increasing. Whatās your PD? Prima F is good to have. It means that you qualified for minimum requirements for VAWA. But does not mean it will be approved.
You can use PF in many occasions, also at school. Depends in which state you live. Google more info about benefits.

@Uscislin linuscis No RFE. I had a good chunk of docs submitted from the very beginning. 2 PF I received. The most recent one was in January and it was for 6 month only.

@moe sh Thank you! You can also submit affidavits from friends, family members, colleagues. Where they will tell about your marriage. Even if it was a short period of time, if someone knew about marrige ask them to give you informative affidavits.

@ade ayo USCIS is smart if you wanna know if it will affect you go to uscis.gov, then go to check processing time, then put I360, then VAWA then Vermont, and check processing time after it brings 33 months, scroll down and put your submission date where it says When is your receipt date, that way you will be told when you can make inquiry, so calculate it from when you submitted you will see if it affects you or not.. my brother

@Elina Burlutchi Elina you can google āwho is my congressmanā and then put a zip code of your area. It will show you the congressmanās office info. Then you call them and ask them to send you a form, or ask how to file a formal letter.

@Elina Burlutchi Good question. You have to ask him for help. Firstly, make your case, come up with all of the hardships what do you have and write down. Then you prepare a formal letter and give it to your congressman office, explaining when you submitted the documents and rest of the case history. Most of the time those congressman officers know how to handle and they might also give you some tips.

@R m Thank you. The evidence was a lease agreement for the apartment, car insurance, affidavits from Friends, family and colleagues. Also, personal statement.

but did you send anything to show that you suffer from abuse from your ex ? like what evidence you sent to show you were abused? did u have a police report or hospital report anything like that ?

moe sh you have plenty they donāt require a whole bunch and if you canāt get certain basic evidence all you have to do is write an affidavith saying why, they expect in abusive marriages you wonāt be able to get important documents but the truth and honesty is important

Elina just ask your congressman to enquire on your behalf on your application, heās not obligated or has any authority to compel or instruct the USCIS to hasten or approve any cases / application all he can do is enquire and make sure that whatever youāre telling him is 100% the truth

@R m I have not had police reports or hospital reports, but had some people around me who admitted that she was abusive and using the immigration case to manipulate me. Whoever came up with the affidavits for me, they are all US Citizens, with thr clean history.

@Krish90 krish I am sorry to hear that. It seems like your case is pending since 2018. Why is that? what does USCIS says?
Did you try to hire a lawyer, or write a hand written letter to USCIS?
Or, request a case inquiry. or contact the congressman office, ombudsman office? You can also schedule an infopass appointment.. Request PF for your case and a few other things. I feel bad for you, but the time will definitely come!

@samira mozhdekanloo I had a work permit from before, then I applied for the renewal. USCIS looked at my EAD application and the VAWA case at the same time and approved them both.

hi @Nick A I have been only a year , but I wonder if something more I can do, I apply for my I-360 and it only said received, the mail me a prima facie, but I was unable to use it bc they said I donāt have status, itās hard not been able to work or do anything and I have very little help from my family at the time, is anything else I can do to speed this up?

@Alise E Prima facie should work, thatās the whole reason of having it. What state are you in? Different states have different benefits.
You are in normal processing time with your VAWA, The average waiting period is 33 months now. Did you apply for EAD with your VAWA? If so. you should receive a card within one year and be able to work.

@Alise E Yes, you should ask your attorney what application were submitted and also ask for the copies of the notices for your record. The same about Prima Facie benefits.

@Nick A applied vawa+ 485 on Feb 2018. got 360 approved on July 2022 then 485 moved to Chicago fo. I got medical on jan 2023 and responded feb 2023. silence since then. I went to Chicago fo yesterday and asked status. they said they received medical rfe but no officer is assigned to check my docs. I asked if they can expididite they said no.
should I apply for ombudsman? will that help?

@m j I would say you are in normal processing time. Usually it takes up to 6-7 month to get a response since you submit the medicals to USCIS.
Better to wait one more month and then submit a service request to USCIS first before goong to ombudsmanās office.
