I-864 Affidavit of Support for 2 in household $24,650?
Am I reading the I-864 instructions? After submitting correctly the form to NVC on February 14, 2023...today NVC sent me an email requesting another sponsor to fill out another I-864 because my $50,000.00/year military pension was not enough!!!!???
Anyone with similar situation?

What!!! I thought only half of that is requested!!! Why tho, that's pretty enough for a household of 2!!!!!!

It appears NVC doesn't consider military pension although the website doesn't excluded. I even sent a 12 month direct deposit to the bank. I might have skip this RFE because it's unclear when the statement states "you may provide an additional sponsor." I'm researching now the USCIS Laws.

We had a similar issue in which they initially didn’t accept VA disability payments from my spouse. We consulted with a lawyer back then and he told us to resubmit everything that we have to prove that we’re getting that money (bank statements, disability letter, even dd-214). I havent heard back since then (August 2022) but I also haven’t received another rfe

Thanks Jan nie. I had uploaded all you said; VA identification card, permanent and total 100 percent service-connected disability with monthly compensation/date retired, etc, 12 month bank statement with the direct deposit, and even my total balance, besides the 1095-B health coverage for spouse, and Tricare/champva coverage. I'm resubmitting the I-864 with an attachment declaration "not taxable compensation from VA Affairs." NVC rejected the February 14, 2023 I-864EZ and requesting I submit the I-864 full version in about an hour. Let's keep tabs.

Up loaded. On the NVC uploading comments box I wrote, "According to military pension IRS Publication 525 (2022), Page number 18, Section - Military & Government Disability Pension is not taxable." ;-)

I, xxxxxxxxxxxxxxx, am receiving a disability retirement annually for total of $_____________USD from the Department of Veterans Affairs for ___ percent Total and Permanent Service-Connected Disabilities since _________.
According to IRS Publication 907, veterans disability benefits are not taxable. Specifically, the IRS says that veterans should not include in their income any veterans disability benefits paid under any law or regulation, or administrative practice administered by the Department of Veterans Affairs. Furthermore, Military disability payments are nontaxable income pursuant to I.R.C. § 104. I.R.C. § 104(a)(4) states that gross income does not include “amounts received as a pension, annuity, or similar allowance for personal injuries or sickness resulting from active service in the armed forces of any country…”
I hereby certify that minimum income for sponsorship is met per the January 19, 2023 Poverty Guidelines for the 48 Contiguous States and The District of Columbia.
I further certify that I am presently residing in Mexico and have been unsuccessful in requesting a IRS verification of non-filing letter/transcripts due to unsecured wifi access and IRS authentication documents are not in reach while away from the United States of America.
I hereby certify that I did not and was not required to file a Federal income tax return for the tax year under review from 2016 to 2021. I understand that any willful falsification of information contained in this Affidavit may result in termination of my disability retirement benefits. I certify under penalty of perjury under the laws of the IRS and USCIS, that the foregoing is true and correct.

Is $24,500 enough for 2 in household if I’m active duty military?

hello Rena. Stick to your grounds. Check the 2023 poverty guidelines and submit your I-864. Do not be fooled, like they tried with me and I held my grounds, if NVC ask you for a sponsor. i attached this letter in March with their RFE to submit a sponsor income. There was no need for sponsorship when even $1.00 dollar about the requirements. Three weeks later i check their portal and bang!!! "submitted" AND "accepted" This week NVC transfered to local consulate for interview in 6 weeks.

They just sent me a RFE stating I don’t meet minimum income requirements and that I need to submit joint sponsor. .

Have you gotten any approval or response? We just got our denial letter yesterday stating not above the poverty level and I am 100% VA also, I also submitted the DD214, 12 month of bank records, and VA letter stating when I was granted 100% total disability. I even added in when my back date pay was hit and highlighted the VA payment each month of my bank records.
