I-751 Pending and Marriage in trouble
I have just applied for removal of my conditions (I-751) jointly with my wife. We married in good faith and have been together for a long time and married 3 years ago but she doesn’t want to keep it going anymore. She wants to get it annulled. What are my options now? She wants to get it done immediately and haven’t even received my receipt for I-751.

you can try to work it out. at the worst get a divorce but never get an annualment, cuz that means the marriage never existed and your green card would be in jeopardy.

she doesn’t even qualify for an annulment at this point. she’ll only get an annulment if you guys never consummated the marriage.
anyways, it’s a good faith marriage like you said so try finding out what the issue is. marriage counseling? romantic vacation and try to spark things back up? compromising? marriage is a scared thing. i wouldn’t advise divorcing unless it’s the last resort.

@leaxly johnly this is not true. annulment is guided and depends on the state laws. for example in south dakota the statue of limitation to bring an annulment case is 4 years after marriage and has to meet some basic tenant’s stipulated by the law of that state. now its very hard to get a judge to grant an annulment cuz the boarding of proof is usually very high to overcome by the plaintiff. so consummation or not, if the marriage is still within that time frame outlined by the state and meets some of the following reasons like fraud, insernity etc. technically the plantiff can still bring a case to the court. my advise here is that you guys work your marraige out and at worst get a divorce but if she insists on annulment fight it and there’s a 99 percent chance you win.

with your i751 once you get your noa and if you have the divorce decree just go ahead and change it to waiver based on divorce. you’ll have to send it in writing to uscis. When did you file the Application?

Don’t let her win. because she is taking an advantage on the situation and she is playing with your nerves end the delay remaining on conditional GC. It is so vicious. courage and don’t give up.

@sal sal. I gave an option for divorce. what if the wife go behind and put in for annulment. was that not what you stated in your first comment before you went all lengthy with the annulment law
