i-751 interview can't be waived
hello guys I am currently living overseas under my husband's orders. I submitted all the documents along with pictures of our newborn at that time since we just had him before mailing my documents. case was received on Nov 2020... on Oct 2021 was changed to fingerprints were taken then November 2021 RFE being sent well when I received the notice there is no additional evidence mentioning other than them asking when I will be physically present in the state for an interview?????? the thing is why should I travel all the way back to the state it's an 11 hour flight non-stop with a baby and when I get there who's gonna watch my baby for me while interviewed since we don't have family in the states I am very confused and I already called them and they told me to wait for a call back. I thought that immigrants living overseas with their spouses get their interview waived that was the point of me sending fingerprints. now I can't stop stressing about the situation

uhh only the fact that I have to travel back to the states as I mentioned 11 hours flight non-stop if im lucky to find one other wise it's so much more longer with a baby and find a place to stay there since my husband has no family and also who is going to take care of my baby while I am at the interview and the expanses of this whole trip. and I have no idea what evidence they actually need Noth mentioned other then when I can make it to the states for an interview

I feel like you're being unreasonable. If you want this enough you will make that interview happen. We all have circumstances that make it difficult. Bring your baby to the interview.

I don't see anything bad in them requesting you to be present for interview, many of us living here don't have family or even friends, we have kids but we still find ways to survive and wait for our documents, life ain't easy anywhere good luck

Zahra - only USCIS can waive interviews if/when they see fit. and that happens rarely. one way that the interview can happen is online. some interviews have been conducted online with the pandemic. while I don't see USCIS force you to travel for the interview if that can be avoided and accommodated a different way, I don't see them objecting to an online interview either. it's a case by case thing to get some accommodations. but as Orla said, it all comes down to how bad you want it. show USCIS that you're willing to work with them to make that interview happen, not to waive it. honestly, that's not an agency that you want to be on the bad side of. get in touch with them over the phone and propose online interview after you've explained your situation. and if you're adamant on not having the interview, either it will be postponed to a very far date from now, or they will cancel your application altogether for you to start over when you can fold to their every request. 🤷‍♀️

I believe you applied using your US address. At this point, most people under i751 may or may not be called to interview. If you are in a military service you can request a embassy interview. Otherwise, I'm curious, if you have a baby before you apply how did you traveled with you baby to your current country?

@joshbigosh no I put as my mailing address our APO and physical our german adress we have been living here for 2 years now so I delivered overseas all I am praying for is an interview somewhere within here at this point we can't even afford this sudden trip back to the states. I still haven't gotten a call back from the office so hopefully they will accommodate us. and for the comments above I am not comparing who has it worst nor taking anything for granted the process is overwhelming for everyone already so unless you can help me with a resources or a positive experience there is no need to comment just to make me feel even worst I just lost my mother and couldn't even make it home. my husband's is the only provider and we are doing barely okay

@zahra I'm not expert but most i751 interview is to make sure the couple is still married, living together etc... I don't think they will interview you at the embassy in your country. I know is going to be very difficult for you but the options are: come to the interview or they deny your case. (it's my non expert opinion). Don't give up, chat, call, email them always when you can.

You are outside of US for more than two years, would not that put your green card in jeprtoy. Is your spouse a military or on official trip? I know that applying for I-751 extended your green card validity, but I thought you cannot stay outside of US more than 6 months or at most a year (somewhere I read less than two years) and more than that you have to get a permit regardless if your spouse is with unless in official capticty. Probably this would not answer your question but something to consider. Good luck

it’s not a guarantee that interview gets waived. Take the flight and also bring your baby to the interview

take the flight. People are waiting 18 months to 2 years to get approved for 751 even with 0 rfe or interview due to 751 not being a priority and backlogs of other types of immigration. Sometimes it requires an interview and other times it doesn’t. It depends on the proof you submitted and sometimes it’s just luck of the draw.

also if ur partner is military, you can get help that way too. I believe those case interviews (military) are easily waived
