I-485 EB3 employment base case out of processing time
Hi my field office is Atlanta here is my timeline:
Case received 08-31-2018
EAD card received Oct 2018
1st interview July 2019 in CA (i was originally from CA)
2nd interview Oct 2019 in GA
3rd interview OCt 2021 in GA
During my 3rd interview, the officier told me he didnt expect to see me here. He said that my SSN and ID has been used by someone else to work at a restaurant in San Francisco. after verify my information, he ask me for my bank statements and tax documents. I sent them to his USCIS email.
It has been 4 months and I havent received any update on my case yet. What should I do?
Should I be concern about my stolen SSN and ID? I have report to the IRS about that.
Should I consult with a immigrant lawyer on my case?

they are heavily backlogged, they have been for the past 15 months. People from Oct-Dec still waiting on their EADs. This is because of Trump, staff shortages, covid, office closures in 2020…

I believe is something else. If you notice there are approvals from 2021 and 2022. But cases from 2018 and 2019 are still waiting.
What is the logic of this?

@paritosh that’s my question cuz I work for the government and I know that uscis don’t have access to ur ssa record, it’s gonna take a court order with a great convincing probable course for a judge to grant uscis access to ur tax and ssa record. that’s why they always ask us to submit it ourselves.

I didnt ask him that question, but he has all of my information including the amount of money I brought into the US in the past which I declared to DHS, when I enter the country. He specifically told me the name of the restaurant in SF that my SSN was somehow employed at.
And he brought my files when he interviewed me. So I believe he is legit.

yes he is legit and most things uscis know about you are things you told them. I will research on how true he was been. my friend is an IO for uscis I will ask him today

please update when you found out. Honestly, I havent received any information about my SSN has been stolen by the IRS. There was no information about the restaurant on my SSN and tax account. I have reported to identitytheft.gov and the IRS but there was no response yet. My family urge me to seek an attorney to expedite my case. But after the interview I felt that I have proved that I stay in GA and is have been working at my current employer for the past 3 years.
