I-485 Case Remains Pending - I-140 EB2-NIW
Hi All, I filed for the I-140 NIW EB-2 in April 2020 and in August of the same year i applied for the I-485. In March 2021 my I-140 was approved. My 1-485 has being pending since them and moved from Nebraska to NBC and i think is in California now. In November last year, i interfiled my Medicals but never got any confirmation from USCIS if they tied the Medicals to my case. In August this year i received an RFE asking for some documentation but no mention to the Medicals. I responded the RFE in Sept 22nd and case was status was changed to "Case Remains Pending" and the message below:
Does that mean that they are not working on my case right now? or they come to a decision but are waiting for the new fiscal year to have a visa available to me?
Also, if the RFE did request my medicals, does that mean that they accepted the medicals i interfiled?
My anxiety is very high right now waiting for the decision :(

The message will be updated in Case Status Online, however, after USCIS takes some other action on the adjustment of status application (for example, issuing a request for evidence, transferring the application between offices, or approving the application).

I read online that this was because the fiscal year ended in September and there was no more Green Card visas available for the category and must likely case would be processed in October, I am just wondering if that is correct? I check my case status several times a day and my anxiety level is very high right now. I hope my case is good and approval will come soon.

Thank you Joey and Kalyan. Does that means that will be approved? ai am wondering that if was suppose to be denied, would be denied already as if they deny, do not matter if Visa numbers are available or not, right? I hope ill have my approval soon. Thank you!

I got the same CRP but unfortunately, the only approvals that I’ve seen are the ones who got “visa unavailability” CRP message. The ones with “transfer of underlying basis request” haven’t received any approvals. At least I haven’t seen any…

I'm in the same situation and this wait is killing me😮💨 I'm an eb2 niw ROW. Filed in Texas in the end of March of this year concurrently, fingerprint mi-april, i140 approved in the first week of September and i485 transferred to NBC the following week. Lawyer didn't include the i693 (to be honest I didn't know I had to send medical, I wasn't really paying attention to immigration processing before filing my own case). Waiting for the medical RFE and I'm so tired already and I know it would add more waiting time to get my i485 approved. No EAD yet so no ssn, very annoying cause cannot work yet and my startup is already behind on schedule

a tiny country from Africa, Gabon! nobody from my country filed for my category during the FY2022 so my waiting time is supposed to be shorter! where are u from? are u in the eb2 niw category too?

@Thiago Abreu did you have any change in your case? we’re also waiting for an Interfiling, ours is from EB2 NIW to EB1-B from July 2022, our PD is March 2021. And we’re still waiting

@JP case was updated to “ Case was updated to show fingerprints were taken” same update of over 1 year ago. Looks like a lot people got the same update….. I am still waiting :(
