I-140 approved from denial. What’s next?
My 1-140 was denied (from RFE in November 2022. My lawyer filed 1-290B on my behalf on the same month. On March 2, 2023, my case was reopened for consideration and was approved the following day. I'm wondering what's the timeframe of my I-485 / Greencard? Both 1-140 and I-485 was concurrently filed in November 2021 but since my I-140 took a different route, when should I expect it?

shouldn’t affect the timeline. now that your 140 is approved it’s moving to the next step. but timing wise it’s tricky to say because they do not go by first comes first served.

@Revi h thank you for this info! If they do not go by first come first served, what’s their process? My priority date is Nov 2021 but visa bulletin now for my case is Dec 2022. I’m a year behind.

no one really knows… I am with current date for a year and half and applied in January last year and am still waiting while colleagues of mine with the same visa type same country that applied months after me already got their green cards last year… and I see approval with the same visa type in the field office I am that applied at the end of last year. So I have no idea what their logic is… definitely not the way they say it is…

@Hope Miracle Faith thank you! case status for I-290B didn’t update until now. I-140 case update instead. I received a letter of decision as well as notice of reopening and approval.

@LarryMark Lanray they requested for RFE initially. Main reasons were inability to pay of the company and multiple beneficiaries. Apparently we were not able to comply to the requirements. To make the long story short, my lawyer, made a defense letter, submitted newly found evidence.

hi @Likes F , when they denied your 140, did they also cancel your work permit (EAD) ? Or it remained active since you filed 290B.
