I-130 Expedite Request
My husband and I have tried to expedite our process (filed 02/21/22) recently and were denied without USCIS asking for any proof. We called a USCIS agent and he was very confused that USCIS didn’t ask for any evidence either. So he “reopened” our request and then we got the email again that they are denying it but again they haven’t asked for any proof of why we’re expediting. Does anyone know what to do so they let us send in proof? Or has anyone had a similar experience and can share with us what helped and if they got approved soon after?

I would recommend uploading it as unsolicited evidence then calling up again to reopen the case

One time I tried to do the same and they denied they adviced it was better to expidite EAD or AP

USCIS call center agents and service centers (who handles these requests) are two separate parties. If the service center denied your request without asking for proof, that just means they didn’t deem your situation worthy of expedite. If your situation meets their criteria for expedite then they’ll ask for proof to validate your claim (even after sending proof they can still deny it). Remember, everyone and their mother is applying for expedite these days. THEY have to find your situation an emergency, not YOU. You can always try again, but just don’t be disappointed if it doesn’t work out. Goodluck

thanks for the replies! one thing that I don’t understand though is how they decide our case is an emergency or not without having any evidence? what do they take as their basis for the decisions that it’s not?

@Laura Don’t try expediting again. You don’t want to trigger then just leave them alone and wait your time. trust me it’s around the corner they are aware of you, you’re not forgotten and they know exactly what they’re doing.

@Laura Sylvana Romero Just wondering, why are you expediting your I-130? I don’t recall any single experience successfully in doing so. And it makes sense because the two biggest reason will be needing to work or travel for family emergency, but I-131 and I-765 would take care of that. I would think they deny without even learning about the cause because they don’t really expedite the petition, rather expect you, according to you need, to submit expedition for either I-131 or I-765.

Okay that makes sense thanks @S L. I am just confused because I heard they ask for proof and whatnot and for us they didn’t even and the USCIS agent was surprised about that…. But who understands USCIS - not me 😂

There are a lot of different experiences, so you’re right! They never made it easy for people to know the reasons behind their actions/decisions. 😂 it would be easier if they provided you the options for other expedition when they denied your cases, right!? Anyway, hope it works out for you in the end! 😉

@Laura R I-130 and the beneficiary is overseas ? it’s hard to expedite I-130 even after outside processing time usually they won’t even do anything
