hi family in Christ,I received Rfe 1) medical exam 2) i864 but the second one is confusing . the letter says Submit a complete copy of the petitioning sponsor's (my spouse) Federal income fax return and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year If the petitioning sponsor's income does not meet 125 percent (100 percent if military) of the federal poverty guideline for their household size, you must obtain a qualifying joint sponsor who demonstrates the ability to support you or submit evidence of assets. See Form 1-864 Instructions for more information. If you decide to obtain a different joint sponsor, you will need to: I they Submit a completed and signed Form I-864, Affidavit of Support, from the joint sponsor, All pages must be present and of the latest edition date. Provide the joint sponsor's Social Security Number on Form I-864. Provide a complete and correctly calculated household size on Form I-864. Submit a complete copy of the joint sponsor's Federal income tax return and all supporting. now if my husband's income is sufficient do I send just 1099 and w2 and tax return Or do I have to file a new i864 form,the last one I sent with the package was 2 years ago

Hello, you need to send everything stated with a new signed form I864. The statement on the RFE is pretty generic and applies to everyone that receives a RFE on this.

Hello , on the website there is a guideline showing the sponsor’s income to # of people their sponsoring ratio. You will need to submit a a copy of your parner’s Income tax/ W2 from last year. If your partner’s income does not meet that ratio I mentioned above, you would then need a co-sponsor. I believe there a special circumstances when the income can be waived, I’m not certain , but if it applies to you I would suggest getting a consultation from a lawyer.
