COMBO CARD received .. should I travel on parole ??
I just received my combo card today. I’m planning to travel to my country Costa Rica for a couple of weeks to see my family, however when my visa and I-94 expired I didn’t got married after 3 months later and I didn’t apply for adjustment of status until this year in April ( almost 4 years later ) should I be concerned they won’t let me in ? we got a 3 year old born in the marriage who is a US citizen!! , because I was legally married all this time but out of status, does anyone can let me know their experience and if anyone has been denied parole for being out of status for so long ?
I’m dying to see my family - haven’t seen them in 5 years

Estoy en la misma situación que tú, got my combo card almost a month ago… me case mientras mi visa está vigente y metí mi solicitud un año y medio después which means I overstayed my visa. I really wanna see my family and spend some quality time with them. my lawyer said that is okay for me to go and should be fine coming back to the country.

I would wait until you get your greencard. I know it is hard but you will be better off waiting here and back in Costa Rica. here you can work and be with your child and wife…if you leave … you are risking it and things may get more complicated.

don't travel @Adela Hale. just wait a little longer. you'll get your visa interview soon. I haven't seen my family in a year and 9 months, my daughter is there waiting for her I130 to be approved and get here with a visa through my marriage. I know it's hard. don't leave! I'm April filer as well.. Pd 04/19. May I ask when in April 2021 you filed?? please. I know they are just now processing combo cards (ead and advance parole together) so.. if you could share your timeline, I would really appreciate it. Thanks in advance!

@Adela; I don’t know why these other commenters are asking you not to travel, but AP is specifically issued so that you can travel and re-enter. Do some research and see for yourself, there are no documented instances of people being refused entry to the US with AP, except for a very few, where the AP holder has been involved in serious criminal activity. As long as you have no criminal history, chances of you being denied re-entry is nil. Travel, go spend time with your family and don’t stress for nothing.

@B Akin All these comments are based on this warning you may found on USCIS website: “If you have been in the United States illegally, then you may be subject to a bar to admission if you depart the United States, even if you have been issued a travel document. For more information, please see Section 212(a)(9) of the Immigration and Nationality Act (INA).” Are you saying it’s safe because there is no documented denied re-entry data available for public? Do you have any other document we can refer to to confirm your claim?

@Sofie; This is fear mongering at best. Yes, this is the policy, however, Advance Parole overrules this. The meaning is in the name “parole” - this means that your overstay violation has been forgiven (paroled). Also, if you can that information, then you can find information on people who have used AP. This conversation has been had on this app several times and the conclusion is always the same. AP works.

Nothing is guaranteed. Not even when you have a valid visa, a CBP officer can still determine that you are inadmissible. There is no need to become paranoid and complicate simple things.

@Adela don’t worry and go see your family, I’ve been in your situation married a citizen lady and went for interview and my case got denied I lost my status 4 years before applying for a new case as soon as I got my EAD + AP combo I traveled to my country for 2 months and half and came back with no issue in US.
