Case is Under Extended Background Check
I had my Naturalization interview in Baltimore back in November, 2020. Since then I didn’t hear back from USCIS. My congressman office got involved and got an update ‘my case is under extended background check’ by the National Benefit Center. That’s why Baltimore FO didn’t make a decision yet. I don’t have a criminal record, not even a driving ticket. I am a law abiding resident and never broke any laws in my life. Can someone explain to me what is going on? How long does these background checks take?

if you don't follow up on your case there will be no update. Often time cases are ignored until the beneficiary or petitioner calls for update or worry them about the progress. don't keep waiting. make the call

Thanks Godsent. I called about a 100 times in the past 5 months. I wrote the officer who interviewed me. I made many inquiries with no luck. This is why I engaged my congressman in the first place. The staff from congressman office asked me to give the a month to do the security checks. He asked me to stop calling them and give them a chance to do their work. He promised to follow up next month again if I didn’t hear from USCIS.

The congressman office said that someone has a similar name to me did something wrong somwhere and accordingly, USCIS is doing more security checks on my case. This is rediculus and makes no sense to me. Why sould I suffer because someone has a similar name to mine did something wrong some where in this world?

sometimes cases get stuck in security checks for a long time. It happens mostly to people who are from countries with majority muslim population. In some cases the only way to have your case moving is a lawsuit.

Yup@Adam k, I believe this is the reason why. I will listen to my congressman office advise and wait a little more. If things stay as is, then mandamus is the only solution.

security checks in certain countries belonging to middle East can take from 6 months to 1 year or even more which is why you should sue them so that they can hasten the check up or forfeit it

Hi Al, I am in the same situation, I had an interview in Nov 2020, at the Baltimore field office and I didn’t receive any decision. I also made so many phone calls, and I am getting an email response “pending adjucation”. It is frustrating .... I didn’t contact congressman. or don’t know the real reason why it is on pending adjucation

Hi Edy. Do you know all your options? Ombudsman, attorney, law suit? Who is you representative?

Hi Edy A, I know the feeling, trust me. Calls won’t help. Inquiries and second tier officers won’t help. Try your senator. Ben Cardin is a senior senator and his team respond within 48 hours. If your case is not stuck in security checks, the senator inquiry will help get the ball moving. If the case is under security checks, you either have to wait or sue USCIS.

Thank you Al, yeah my case stuck, Have you ever contacted Ombudsman office? I made a phone call last week and I am waiting a response from tier 2 a phone call. if Tier 2 can’t give me specific answer this time I will contact either Ombudsman or the senator office and at least I will know the real reason why it stuck.

I did contact Ombudsman. Its been 2 months with no response. USCIS didn’t tell me my case was stuck in security checks however they told my congressman and he communicated the message to me. If you want a real update on your case, contact your congressman or senator.

I contacted my congressman office, I am awaiting the response. i also talked to Tier 2 officer (IO) last week, I asked where my case stuck, she said she cant tell me such info. It was absolutely meaningless to contact tier 2 officer

Mine is stuck at: "We put you inline for oath ceremony" for 60 days now. I do not know the reason as many others who were interviewed on the same day attended it 45 days ago.

Court filing fee is $402.
I am currently in the 60 day period waiting on them to reapond.

So i have an update, on day 62 after filing the mandamus, my case was approved. I will give more details later on. But one thing for sure guys, Mandamus works. Jeelani Law Firm is awesome.

Wow Congratulations,!!! is Jeelani law firm directly file lawsuit to district court or they first contact Assistant attorney ? My lawyer advised me to contact government attorney with complaint ( exact copy that to be filed to District court) first with specifc deadline and if not decided by that date to file to the court

Edy A, they sue right away. They open communication channels with the Government attorney towards the end of the 60 days. The reason for suing right away is that all agreements between AUSA and your attorney becomes court documents and a federal judge approve them along the way. If court is not there to supervise the process, USCIS will not have the appetite to commit or respect their promises.
Don’t believe in what people say, that USCIS will retaliate because you sued…its not true.

Edy A, they did that with me. I agreed but on paper with a promise that my case will be adjudicated within 30 days. After 48 hours, case was approved.
