did they send you a Noid before denied?

you might filled something wrong on I485 and they couldn’t make your change of status

Vlad, did you get into any trouble as a student? Was there any time you were out of status? Was your status ever terminated? Was your SEVIS Record always updated? These are likely reasons for denials of F1 to EB

Sorry to hear that... I am going pretty much the same way. I heard about a lot of people who got their EB GC with pending asylum, but also heard that USCIS rejecting people who applied for Asylum while out of status. what is your situation? Were you out of status when you applied for Asylum or not?

Anton, NO I WAS NO IUT OF STATUS. I applied for Asylum and dropped my status after 3-4 months

@Vlad I’m also a “pending asylum status” and applied for eb3 my lawyer said I can’t adjust in the state and I’ll to go abroad to get my GC - so check with a lawyer

@Oz taha, So what are your steps right now? Did your I140 got approved? Are your documents in NVC?

I’m in the nvc stage , but didn’t get DQ yet - I’m honestly will risk cause I’ve been waiting for 6 years now + my lawyer said he had a similar case that went through consular processing and it was fine. my understanding is if you get AP (I didn’t) and secure an interview in a country other than yours then you should be fine (you can do this by trying to get some sort of residentship in the country you are planning to interview from first - but pick the right country cause there’s a huge wait line in some embassies too)

what countries can yiu fly with no visa? Find out those countries and them send them email. I would say, send 20-30 emails to 20-30 embasies. Explain in the email your situation and then wait for their response.

sent 40 so far almost half replied with a no and the rest didn’t reply
