Pretty sure an RFE pauses work on all your cases. The EAD is dependent on a pending I-485. They don’t want to approve the EAD yet because if you don’t respond to the RFE, the I-485 will be denied. Focus on the RFE and make sure you respond properly instead of worrying about the expedite for now. Once it’s solved then your EAD will be in the queue to be approved.

I’m in the exact same situation as you, expedited I-765, faxed the evidences two days later a RFE on I-485; an issue in the form I-864. I responded to the RFE three days ago and still no response on I-765 or I-485. what was your issue with I-864?

@S A same issue for me too, my wife used to live with me in France since we got married in 2018. she has never filed tax in the us. they asked to provide I-864 and her tax return. I provided I-864 and a letter explaining that she was not required to fil tax because she has never worked before. that was my response to the RFE. know that I already provided a joint sponsor I-864 and his tax return.

@S A I’m in your exact shoes. officer asked me to fax evidence to expedite my Ead. I also got a RFE for tax documents and already sent. USCiS hasn’t updated they received it yet. Talked with an agent and told me to be patient . I’ll get it soon

I uploaded mine online and it said RFE response received straight away. but I guess they haven’t started working on it again.

I am in the same position I expedited my i765 got a RFE for a joint sponsor. I uploaded the RFE to my online account and immediately got an email stating they have start working on my case, however I am still waiting on my EAD

@S A I filed 06/06/22. I only got RFE for 485 tax documents. Faxed EAD documents for financial loss. Agent said she can see the fax was received . FedEx response for RFE was delivered Dec 29 . No response from USCIS yet. My case is marriage based at NBC. Praying we all get approved soon 🙏🏾🙏🏾🙏🏾🙏🏾

So it's clear after speaking to a few people, whenever someone expedited their i-765 case based on i-485 with missing evidence, they will request evidence before producing your EAD card. Seems very stupid if you ask me!

@K K, they actually just keep offering to refer me, tier 1 are contractors we speak to and tier 2 are actual USCIS officers

@blessed Queen what proof did you fax. my situation is similar to yours. got RFE for a joint sponsor in December upload the response in my online account. USCisemailed that they have started reviewing my case. requested expedite for EAD fax proof but don’t here anything after that.

Your RFE response must be accepted, before the can process EAD.

@S A what year tax return did you submit?? .I am same as u I request expedite then I got RFE... my sponsor 2022 return haven't filed as yet....soo I submitted 2021.

so they probably won't respond this is my third one, my second expedite request was on the 16 of February but because the RFE was already pending from just after the first request was placed they denied it. I sent the 2022, she filed single even tho we are married. 2022 and I also expedited for a third time through a congressional office.
