Normally at the last few months of the fical year the availability of visa is so low already its either they move forward, stall or retrogress. If you look at the data and most predictions the probability of it retrogressing is higher so my bet would be the start of the fiscal year which is October

if they’ve issued only 4000 visa till date why won’t it move ? If it doesn’t move, won’t the available visas go to waste ?

i heard they only issued 4000-ish green card only for this year out of 10,000 green card. Hopefully they would speed up in the upcoming months to at least catch up to that 10,000. But hope is just hope.

@ChipuKu Singer do we have that data released by USCIS? If attorney can look then we can as well. Otherwise it’s hard to believe that just 4k visa was granted till almost end of the fiscal year.

@Mr X BDV has a guy who was a former officer... possibly he has contacts that gives him info. But it will be so preposterous if that info is true

@Mr X I have no problems with BDV. I like the way they communicate. as @X Y said Chris is a former officer and he came with that info but he was also honest saying that it is very hard to predict right now

@Z Q I doubt 2023 can move like that again... best case is they will move it back to June 2020 where it was before and rush through those with CRPs

The start of the problem with EB3 Unskilled isn't really that there are too many applicants beyond quota. It is because USCIS/DHS failed to use enough visas available during previous years especially during covid years... and now there are so many carryovers from 2018-2020. And those unused visas were not carried over... just wasted

@Z Q Then why don’t they distribute? still a lot of people are there with PD before 2020. Still if visa will be more then why are they still retrogressing? so that 4000 figure doesn’t make sense.

based on USCIS’s data, the maximum number of EB3 unskilled green cards given out was around 4900 which was in 2019. there were certain years where they didn’t even give up to 500. again, the 10k maximum was set as a deterrent; not a goal because if that was the case, we wouldn’t be dealing with backlogs of any kind in our category.

I just watched the video on YouTube He said 3 to 4 to 5k He didn't give an exact number. I'd say 5k makes sense There's noway there are 10k approved I140 prior to Jan 2020 still pending I485 adjudication. And he also opined there might be fire brigade approvals towards end of 2023 fiscal year. Perhaps it will move forward. Let's keep fingers crossed

Based on my research, Im pretty sure the 10k green card IS indeed the limit for other workers category AND what they aim to hit as close as to that number every year too, not just only being the limit. So, like a guy who commented earlier, I really hope that there will be a fire bridage approvals in the next couple months. I wish the best to everybody. It just doesnt make sense not only for us but also for the sponsored-employer to wait freaking years to get some labor.

@ChipuKu Singer when I heard Chris saying about the 4/5 thousand approved so far I was wondering why since we are under retrogression for almost a year. why it takes so long for them to clear it up? so in my mind if they only approved 4/5K they will try to speed it up to reach the 10K until September. let’s see! can’t wait to close this chapter.

Altogether, if this is all true The decision to move it from June 2020 back to Jan 2020 makes no sense at all then! Like it was actually a wicked thing to do. Let's see what happens.

L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW final action date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.
