Asylum Status Dissolved
I am now an adult, came to the States a teenager as a derivative under my mother. in 2015 she legally became a US Citizen. But i was now an adult and still under the Asylee Status never adjusted my status to permanent resident. i have never left the country and been legally authorized to work indefinitely. What is it going to take to renew my Asylum status and adjust to Permanent Resident/ Green Card.

Is it possible for your mother who's now a us citizen petition for you as a immediate relative and then you can adjust? I think that would be easier.

ok, so she would have to reapply for an asylum status for me again to become an asylee grant status again before i work the i485 to adjust status to permanent residence. Since i am also married with kids now, can my green card holder spouse apply for me???

I think is not necessary to reapply for asylum, she can petition for you with a I-130 petition for alien relative because you are an immediate relative it doesn't matter the age. But still it would be better if you visit a lawyer.

Yes your green card holder spouse can petition for you, my husband did it and now he's becoming us citizen, the process with your spouse as a green card holder is going to be extremely long, if he can apply for citizenship and then update his naturalization certificate like we are doing is the best way.

Tricia - you seem to contradict yourself. you say you're under asylum status and also that it was dissolved. which is which? what status do you have now? if you're an asylee, then you have a few options: - you don't need anyone to adjust your status. with asylum, you can file for the GC right away, if you've had it for over a year. after 4 years with the GC, you can then apply for naturalization. - or you can have your mother file for you as she's a US citizen. but with asylum, you can do it yourself and don't need any sponsor. now, if you no longer have asylee status, the story is a bit different. what status do you have now?

well i really appreciate this information, I came into the state a teenager and was granted asylum derivative under my mother. i have been under that derivative asylum status since, until my mother became naturalized as a US citizen in 2015 by then i had attained adulthood and i am now not sure how to go about this. the field office advise me to file form i539 to activate my asylum status and then proceed from there.

Tricia - ok. that's tricky. if you still have asylum, then you can apply for the GC right away. did you have a lawyer back then, because they should have let your mother know that she could petition for you too as she did with asylum, or at least tell you as an adult by then that you could apply for the GC. 😕 so yes, if you're still an asylee, you qualify for the GC right now. if not, yes, file the I-539. but I would suggest you seek counsel from an Immigration lawyer too because your situation is definitely a tricky one, and you want to be sure that you have the correct information. 🙂 just a question, if you don't mind me asking. what status do you currently have? because the I-539 is to extend or change a nonimmigrant status. keyword here is "nonimmigrant". asylees and refugees are immigrants.

i dont know, i lost my 194 and just requested a replacement and it was approved for employment purposes. my i94 status is indefinitely and employment authorized , but i really don't know what status i am now.
