Anyone here filed for AOS in last week? My petition was rejected by Uscis citing “visa is immediately not available” anyone in the same boat?

eb1 ran out of visas; new visas are available starting 1st Oct. you can apply again in 2 weeks.

no, it is using my EB1A petition and we used the PD from EB2

why is that? they should still accept AOS and 485?

@wizard m, You can only file for AOS when visas are available and your PD is current. In your case, while your PD is current, you cannot file because there are currently no visas available. You need to wait till October when visas will be available.
