864 RFE
hello everyone,
I just received the RFE ( request for initial evidence) for my I864 form. Upon reading the RFE, I am not clear on where my first submission fails. it gives me 2 options: add a joint sponsor, or submit the form and support files once more as the initial files came with I485 are considered as “has deficiencies”.
I saw other people’s file and usually USCIS will state where the problem is. I wonder whether it’s because of my case is missing the tax form of year 2023? I files the 485 on 03/29/2024 and at that time the we haven’t file the tax forms for year 2023 yet. I didn’t expect a RFE so I’m quite worried recently, and any advice would be helpful, thanks!

it's funny why you didn't file your 2023 tax return on time when you knew you were going to need it as part of your application.
am.sure you already did by now and you can just send it to them asap so you don't delay your case unnecessarily.

Send 864 again with 2023 tax returns. Make sure you are at 125% above the poverty line for your household size. Did you see the RFE online? I got one that same day but didn’t see it yet. I’ll check again tonight.

thanks guys I will resend the tax return. yes, I see the RFE online under the I485 tab. We tried to file the forms before USCIS raised the application fee and thought 2022 tax return would qualify and also submitted the payslips as well. just want to know whether the tax form from 2022 and 2021 would be the culprit as the RFE didn’t disclose much

if this is spouse sponsored, you cannot sponsor yourself. Your spouse can only sponsor you. if he or she doesn't have enough income to meet the the poverty guideline, then you need a joint sponsor. Your income will not count even if you filled joint taxes. you must send the IRS tax return obtained directly from IRS (not the 1040 tax prepares gave you, USCIS will require a lot more evidence before they accept it), you can download thr processed returns directly from your spouse IRS account or your joint sponsor IRS account. if you resend what you have, your case will be denied.
