I think if is marriage based you need an interview, that's what I had to do.

consular processing is for spouse beneficiaries living abroad (not in the US) if the foreign spouse is already in the US then they can simply adjust their status and apply for visa without having to leave the country

I think if you are already living in the US and are out of status you'll have to do do a 601 waiver not entirely sure! and then you'll have to go to your country and then have an interview to be able to come back in as a green card holder.

ah thanks for the response. yes I am in the US for 25 years, sounds like I’ll have to do a waiver then.
