After years of USCIS problems, I finally sent a Notice of Intent to Sue. I normally don't share my whole immigration situation, but today I decided to because I know I'm not the only one tired of waiting on USCIS. My immigration journey started around 2019, and trust me, it has not been easy. I want to be fair. I had an inadmissibility issue that required a waiver in 2020 after my I-130 approval. That was my issue to fix, and I take responsibility for it. I'm not going to sit here and blame USCIS for everything. But what happened AFTER I tried to fix it is where things got crazy. At the time, I had a TPS matter and an adjustment of status matter—separate cases, separate waivers, separate receipt numbers. Somehow, the waiver for my adjustment case ended up connected to the wrong matter. Long story short, after trying to straighten everything out, I eventually filed a new I-485 in late 2023. USCIS sent me an RFE asking for another I-601 waiver. Okay. I did it. Paid the fees. Got legal help. Filed the waiver. USCIS received it and gave me a receipt. Then USCIS denied my I-485, saying they couldn't find evidence that I filed the waiver. HUH??? 😭 I'm sitting there looking at a receipt FROM USCIS showing that USCIS received the exact waiver USCIS is telling me they can't find. You can't make this stuff up. So now I had to fight to reopen my I-485 because of a waiver that was already sitting somewhere in their system. Eventually, they processed the waiver. APPROVED. I was so happy. I really thought, "Okay, we're done now. Green card next." USCIS said: "Girl, not today." 😂 Another RFE came. Updated medical. Updated financial documents. Updated tax information. Fine. I did ALL of it. They received everything in September 2025. And then... 🦗🦗🦗 Nothing. I've waited. I've made inquiries. I've reached out for congressional assistance. I've tried the administrative options available to me. Still waiting. That's why this has become so frustrating. I'm not asking USCIS for special treatment. I'm not asking them to ignore my history. I'm not even saying they HAVE to approve me. I'm saying make a decision. Because what else am I supposed to give them? You wanted the waiver? I filed it. Couldn't you find it? I sent your own receipt back to you. You processed it? It was approved. You wanted another medical? Done. Financial and tax documents? Done. RFE response? Received. At some point, enough is enough. And anybody who has been stuck in immigration limbo knows this isn't just paperwork. It's money. It's filing fees. Attorney fees. Medical exams. Mailing documents. Starting over. Paying again. And then there's the stress. Lord. 😭 Checking USCIS before you even get out of bed. Checking it again even though you KNOW nothing changed since the last time you checked. 😂 Getting an email and almost having a heart attack. Seeing somebody post “NEW CARD IS BEING PRODUCED” and being happy for them while quietly asking God, "Okay...so when are we doing mine?" 😭🙏🏾 Well, today I finally did something different. I sent USCIS a Notice of Intent to Sue. I'm allowing them to adjudicate my pending I-485 before I move forward with deciding whether to file a federal mandamus/APA lawsuit. And again, I'm not demanding an approval. I want a DECISION. If I qualify, approve me. If there's a lawful reason not to, make the decision. But please stop leaving my case sitting there. I mailed the notice and also sent it electronically. Now... We wait. Again. 😂🙏🏾 I'm praying I don't even have to file the lawsuit. I'm hoping somebody gets the letter, pulls up my case, and says, "Why is this still sitting here?" Maybe nothing happens. Maybe something does. We'll see. But after everything I've been through with this case, I felt like I had to try something different. Yesterday on my way to work, I told God, "Give me a sign and time to take care of this intent to sue letter because I have 3 jobs; I've got no time." When I got to work, my kiddo was sick and was sent home, so I went home early. That's when I said, "Oops, God gave me time." And I helped a friend with some documents. She insisted she wanted to pay. I refused, but she still Zelle'd me. She Zelle'd the correct amount I paid to mail the papers. Isn't God amazing? So that's where I'm at. Notice sent. Clock started. USCIS, the ball is in your court. 🙏🏾 And listen... If I come back here with “NEW CARD IS BEING PRODUCED”... Y'all better prepare yourselves because I'm going to lose my ENTIRE mind, and I'll post about my Lord everywhere 😂😂🙏🏾, and I will still post about him regardless of the decision. The biggest gift I have is being alive and healthy.
