Doesn’t look like the immigration ban is gonna last past summer.
ANALYSIS: Possible Implications of Behdin et al. v. Edlow PI to 75 Country Pause While the Behdin case was technically filed to challenge the 39 country travel ban (Proclamation 10998), the judge recently granted a Preliminary Injunction. This is a massive deal because the legal DNA of that case is very similar to the 75 country pause we are all dealing with. Here is how the Behdin win may benefit the 75 country lawsuits: **1. The Adjudicative Hold is Now Legally Vulnerable** In Behdin, the judge ruled that the government cannot place an indefinite hold on applications just because of someone's nationality. The Connection: The 75 country pause is exactly that, an indefinite hold where consular officers are told to pause and issue 221(g) refusals while the government reviews tools. The Takeaway: If the court found it illegal for the 39 countries, it is a huge precedent for judges to rule the 75 country pause illegal for the exact same reason. **2. The APA Violation** The Behdin judge found that the government likely violated the Administrative Procedure Act (APA) because they changed the rules via internal memos instead of a public Notice and Comment period. The Connection: The 75 country pause wasn't a law; it was sent as Consular Cables to embassies. The Takeaway: By skipping the public’s right to weigh in, the government made a procedural error that judges usually fix by vacating (deleting) the whole policy. **3. Rejection of National Security as a Blank Check** In almost every filing, the DOJ argues that the President has unfettered discretion over who enters the country. The Takeaway: The Behdin ruling proved that National Security is not a magic word that lets the government ignore the law. The court ruled that even when screening for security, the government must follow the rules. This weakens the State Department’s defense in all 75 country cases. **4. Pretext** A major part of these lawsuits is proving that the government’s reasons are fake (pretext). The Connection: The Behdin judge looked past the security excuses and saw a discriminatory ban. The Takeaway: This gives the Ivanov judge a green light to look at the "Zombie Data" (the 1990s welfare tables from the USSR/Zaire) and conclude that the Public Charge reason is just a cover for an illegal nationality-based ban. **What’s Next?** Because a federal judge has already decided that these types of nationality-based holds are likely illegal, the government is now on the defensive. If judges follow the Behdin blueprint, we could see the 75 country pause lifted globally this summer.

Les cuento, Mi caso por el estatus juvenil empezo a principios del 2022, Mi fecha de prioridad es 28 de Noviembre del 2022, Yo envie la I-360, I-485 y la I-765 en esas fecha. Por que se envio la I-485 En el 2022 si apenas me Habian aceptado? Porque Yo soy colombiano y si se Fijian en esa fecha en el boletin ( Noviembre del 2022) de visas, Colombia no tenia linea de espera en la visas, lastimosamente justo ese mes juntaron a todos los paises y se formo la linea en la que estamos todos, pero yo Alcance a enviar mi I-485 y me citaron a huellas en enero del 2023 y Ahora solo aparece pendiente por una visa. Mi pregunta es, cuando llegue mi fecha de prioridad puede que sea mas rapido todo? Ya que desde esa fecha envie todo? Alguien mas está igual?

RFE AFTER 4yrs! 😢
Hi everyone, So,I got RFE from USCIS after waiting for 4yrs. I applied April 2022 and have obtained about 6 Prima Facies. Also, I’m on my second combo card which expires 2029 and an asylum case pending. They are asking me to give them more evidence for: 1. ⁠Good faith marriage 2. ⁠Shared residence The truth is, I literally have nothing more to give them other than statements and maybe a few pictures. My lawyer is suggesting that I reach out to neighbors in the state that l lived with my ex to ask if they could write statements for me. I know no one in that city and I moved from that place from 2022. The ex husband did not want my name on anything and made it so hard for me to get anything done re paper work. I honestly feel stressed,scared overwhelmed and lost. I’m a sense I feel so defeated and very close to wanting to pack my bags and leave this country. I’m tired. 😪 😢 🤦🏿‍♂️ So far, I have secured about 5 notarized statements from friends and people who know of my marriage. My deadline to respond yo them is May 18,2026. I don’t know what else to do. What do suggest that I do? Thank you.

Can I respond to RFE directly if the RFE is addressed to my attorney
Me and wife got RFEs for missing polio vaccines. Our attorney is asking for more money to respond to these. We already paid a substantial amount during filing. After doing some research it feels like I can respond to it myself. It only needs updated I-693s from the medical examiner and submitted those with a copy of the RFE letter and a cover letter. One concern I have is the RFE letters are addressed to our attorney and not directly to us. Can I still respond to the RFE directly without the attorney? Any suggestions here will be very helpful. If anyone else has responded themselves to such RFEs, kindly share your experience. My wife is not working yet and paying more to the attorney puts us under more financial stress
