US Citizen Petitioning “Married” Brother
Hi guys, I need your advice. As a US citizen I am planning to petition my brother, however, he is still legally “married,” but separated from her previous wife. He is in a relationship with another woman. How do I handle that situation in terms of the documents from him that I have to summit in the application? Do I still need to include his current marriage certificate? Do I still list him as a married person? How this situation affects the process? What documents from him do I include? By the way, he has an unmarried daughter with her previous wife who is over 21 years who does not leave with him, do I include her in the petition process?

well I am a beneficiary of a brother petition, my priority date was on Aug, 06/2007. I am current on filling dates and not yet current at final action date bear in mind that I130 was approved back on 2009 and I submitted an AOS while I am on B1/B2 due to inability to go home ...iam still waiting for my EAD to be approved.

You have not mentioned the documents I need? What about if he is “separated” from her wife although they legally continue married? How that could affect the process? Any advice or experience about these cases?Thank you.
