You must now submit a motion to terminate for the Judge to sign. I suggest you hire a lawyer to do this. After the judge signs, you will return to USCIS, if you are already trying to adjust your status there.

I have a lawyer and I already had my interview at USCIS. I thought ICE will contact the judge. Can I meet with the judge even before my court date which is 16th August?

The judge took 7 months to sign my motion to terminate. But I never had a hearing scheduled. If he gets your motion before the hearing, then I think you're free.

Does that mean the motion will be sent through mail before my court date ? I just want this to be dismissed before my actual court date in August.

Once you have the ICE (Government) document decision physically in your hands, send the motion to the judge. track your case and motion on the EOIR portal with your A-number.

You have a good chance the judge will look at this before August.

No arrest or criminal conviction of any sort. it was general knocking on the door and pick up during Trump period. That was how I ended up in immigration proceedings.

@Almiscarado O Yes, that's the way. On my first attempt without a lawyer, I tried to ask the judge direct and the judge sent the request to ICE which they refused. I hired a lawyer who said we have to try it with ICE first and then go to the judge. It worked out. Just remembering that I already had an I-130 approved by the USCIS, that was the condition that ICE agreed.

@Musky do you have a work permit from the marriage case this whole process or nothing until your proceeding is terminated? im asking for someone who’s in the position but worried that they won’t give him a work authorization

I had work permit and social regardless of been in immigration removal proceedings. it doesn’t affect those.

ICE dismissal and motion from the judge both took like a month plus. anyway, I know the next thing is to contact USCIS as my interview has already been done. how fast can I go with USCIS? should I take book appointment with uscis and take the letter down myself or it should be sent by mail ? I just want this to be done and over with asap. your view ?

My lawyer did the letter, but I think you can do it yourself. attach the judge's decision, your i-485 receipt and administrative termination letter they sent you in the past plus your approved i-130 if you have it. All must be copies. Mail it to your field office. If they don't reopen your case within 1 month, schedule an Infopass.

FC 1985 USA am waiting on the letter from the judge. I don’t how fast I can get it. The EOIR portal has confirmed dismissal of my case but do you think the letter should be sent out from the court instantly? Am still waiting to receive it.

I read through all the cases that was opened after submitting termination letter from judge, I noticed none said there green card was sent or approved rather than still waiting after reopening is this not a bad sign that one still has to wait for many months to finally get the card ?

My case was reopened and they scheduled an interview for 30 days later. In the interview I made the mistake, guided by my lawyer of not taking my i693 Medical Exam, so I received an RFE to send it. since then i have been waiting for an answer for 60 days.

@FC195 USA as for me, the officer took mine from during my interview. I did my i130 and i485 interview same day. she also took my passport and i94 and checked through it. On my case status, it says interview was completed but have to be reviewed due to my immigration proceedings. I simply hope am not going to do another interview again. My field office is Houston Texas. where is yours ?

In March 2021 I did my first i130 and i-485 interview. The officer also took my exam. The i-485 was administratively closed for the same reasons as yours. In my second interview, April 2022, my attorney said my exam was still valid and I shouldn't worry. But that's not what happened, I got an RFE that delayed all my plans. In most cases I read, they don't do a second interview, but my lawyer had sure that the ORLANDO field office does and it actually happened.

The first thing the officer asked for was the exam. Then said he would give me an RFE. She said we hadn't enough proof that my wife and I are still together. My lawyer was furious about this because we already have an i-130 approved. but she did. And yes, I went with my wife. if i can advise you, bring exactly all the documents you toke to the first interview. But, again, I think you might not get a second interview, especially in Texas. I sent you a link that shows cases like ours, and there's a guy from Texas that he just need to mail some evidence and he was approved.

when you put your A number, it shows that you don’t have any future hearing again. aside, it will show the date the motion to dismiss was made. also, if you call the EOIR number and dial 3 for voice prompt, it will tell you your case has been dismissed and 1 will tell you that you don’t have a future case or date again.

firstly, have you been dismissed by ICE through PD ? and if your lawyer claim to have send it, maybe the judge has not just put hand to it. it varies or depends on the judge loads of work.

I sent the letter by putting the name of the Office that interviewed me in front of the envelope thereby directing the dismissal letter to her. I hope this is not a bad thing to do? I am just thinking it could make it more faster or is there any bad side to that ?

@FC1985 I didn’t send my i130 copy plus i485 with the letter to USCIS. my lawyer only sent the letter written by the officer, the judge dismissal copy and a letter written by him stating the motion to reopen my case which he typed. I hope they will be able to trace my case without the i30 copy and i485 too ?

I can't say if it works like that. I said how I did and it worked. But it seems obvious to me the USCIS has the information that you have an I-130 approved by them. By the way, I already have my GC in hand. I took 10 years. Keep me informed. Good luck,

just submit it. the judge signs it and it will be sent to the address you provided in court. you can also pick a copy yourself at the court, then you send the copy along with I30 or whatever relief you have. to USCIS.
