our case was finally approved yesterday but didn’t get the notice until this morning. you guys know it’s been a looooong road, and we still have the embassy interview… but this was the big hurdle to get over. we are still in shock!

Congratulations!! This is big news! my husband is March 2020 and he got his biometrics done on 12/15/2020 just one day before your husband. This really gives us hope. I hope we start to see more approvals from 2020!!

their case was approved because they filed a writ of mandamus - this costs $5000…. his priority date was March 2020, so I don’t think it would be worth it?? unless you have tons of money …

I might not be educated on the matter, but wouldn’t filing a writ of mandamus make your case more “sensitive” like USCIS can deny your case? Please educate me. I do not know much about a writ of mandamus.
If you go to the “Case Approved” tab you can see the case - they didn’t use a # so it doesn’t come up when you look for it that way.

Leo , I ask that question my lawyer he told me no it doesent make any difference , only they when you file mandamus the uscis will have 90 days to respond to you , you can file only if past 27 months no less ! in your case I wouldn’t spend all that money Becouse your so close

@leo- I don’t know much about the writs except they are expensive and you are forcing the USCIS to make a decision. In a sense, it can cause the USCIS to deny your case, perhaps if you didn’t have a strong case to begin with. our cases are subjective, and subject to the adjudicating officer’s review… so if you make them review your case, you are making them make a decision. if you have a cut and dry case, like an employment authorization (765, I think), that’s easy. our cases have layers, lots of checkboxes for the officer to check off, hardships to consider… I was originally contemplating filing a writ but realized that our cases need time and consideration. even before COVID, they had one of the longest approval timeframes.
I guess what I’m saying is, as painful as it is, it’s better to wait. I know my case somehow was miraculously approved (I really do give all the glory to God, and it was a present day miracle for us), and it’s easy for me to say “oh just keep waiting” but in the end I promise each of us will see freedom, in some way or another.

Thanks for taking the time to share your knowledge, guys. Wife and I talked and we’re going to continue waiting and leave in the hands of God. We were little college students when we sent our application so we had enough evidence but nothing as strong as a kid, mortgage, etc. so we don’t want to risk it.

aww, that’s so cute 🥰 well, if it makes you feel any better, having kids together doesn’t guarantee that they’ll approve it. it all comes down to hardship for applicant and the petitioner.

hi Dardan! we are preparing all of our documents for consular processing. my husband had to obtain a certain type of birth certificate and criminal record (which is none thankfully hehe) from Honduras so that’s taken two weeks… we are almost done though. this process never ends I swear. I hope you’re doing well. I know this whole thing is soul sucking.

Trust me all I know! this RFE is driving a bit nuts now - lawyer is advising to send ALL new evidence form the last 3+ years since we last filed. But it will ALL be worth it.
