if you’re out of status u can’t file concurrently only us citizen spouse can file adjustment of status no matter if they living here with status or not

but if u are in status then u should file everything together meaning if u have some legal status

You can as long as you are in status. Good luck and make sure you include I-130 receipt with your I-485 package

You do not need to be married to US citizen to adjust status. Priority date is current to all countries and visa is available. I am a green card holder and my spouse is adjusting her status in the US while she is on F1 visa. I have submitted everything concurrently and about to have an interview!

@ Juan bu applied end of Aug 2021 and status changed to interview schueduled in May 2022 and the interview is by end of this month.

@tas smith In around 2019 the priority date become current for F2A since then you are allowed to submit everything as long as you have status on the day that the application has been received.
