i filed form I-824 and it was received on May 9th, 2022 . it’s been a month and half I’m still waiting. Hopefully it isn’t much longer! but I’m hearing it could be a while

yes I filed this for my spouse. I left the consulate question empty like an idiot on form i824, so since I didn’t specify that they approved it but told me I have to file i824 in the I-797 Notice of Action. I printed it out and filled it out then mailed it to them with a 465$ check . That is the filing fee for this form . yes the petitioner submits this

what is your first three letters of the receipt? which address did you mail it to? I hope you will hear something soon.

@wael - Ohhh ! Thank you Wael for responding. so basically, all LPR’s filing for a spouse outside the US need to file this correct? Also, is it a must to mail this form with the check or any other method of sending these to them? If it’s mailing, how do you find the address to mail it to?

AND should I wait till I get I-797 approval notice on mail to file I 824? or I can do it right away after getting approval notice online?

if you chose consular proscessing on form I-130 then there is no need to file form I-824 . I only filed it because in my I-797 notice of action they told me to file it so they can send my I-130 to the NVC

the first the letters of my reciept are MSC … I mailed it to the Chicago lockbox because my I-130 reciept number started with IOE. it all depends on what the reciept number starts with. Now my form is at the National Benefits Center

right, got that Wael! thing is we have filled in both 61 and 62 questions in the I 130 petition. whereas we only could have filled in just one, but the questions were misleading about the consular processing and we ended up answering both. so in sucha situation I should file I 824 yes?

oh okay I see . well the issue is that from what I’ve been reading is that form i824 is a real bad form to wait for it can take really long . some lawyers advice clients to just start a whole new i-130 application all over, that it’s faster that way. I would wait till you get your 1797 notice or action and see what they tell you to do. My Brother left 61 and 62 blank on his I-130 for his spouse almost a year ago , and they told him on his notice of action that they would chose the US Embassy for him since he didn’t specify . Guess he got lucky . i did the same thing and they told me since I didn’t specify for consular processing that I must now file for I-824

@Wael - Damn! your brother got lucky! however, I’ll try contacting an officer today and see what he’s to say. if no option , will have to file I 824. GT: call USCIS to fix your I-130 that you want consular processing before they approve your I-130. This way, you can avoid filing I-824 later

i would file a new I-130 if I were you . I’m going to wait 3 -4 months , if it’s not approved then I will file new i130

wael A, can you file i130 while they processing i824 form?

I’m not sure how to go about it to be honest , I would call USCIS and see if it’s even possible . or try speaking to a lawyer . i think it’s possible because I’ve watched videos of lawyers saying that they tell their clients to just file I-130 all over rather than filing form I-824 because it’s quicker that way

hello guys I just got my mail back from uscis about my I 824 they denied my application due to forgot to send the fees and they asked to resubmit my form again anyone know how long it will take after they cashed out my check to get approved?
