they havent denied mine. im in o1 visa but thinking about switching to a better job using EAD card. As an NIW petitioner, im not connected to a specific employer. But i ask if it’s too risky to leave my o1 status to rely only on EAD if the i140 has not been approved

That is good news. 😊 I applied for NIW-EB2. I-140 is approved. Waiting for the I-485 approval. It’s a very good option for those who don't have a sponsor.

@Ana Sampaio please what is criteria to qualify for NIW-EB2 category. can a registered Nurse with bachelor degree qualify? is the NIW-EB2 attached to a specific profession or anyone can qualify? please help me understand. thank you

what about the new employer file the I-129 on your O1 visa for the moment?

i thought about it but I prefer to use the EAD and start as soon as possible.

I personally work and completely rely on niw ead card from couple of months till now (recently received an rfe). I hold no other visa. If you’re a risk taker and want to move for a better job that will be your call as nothing is guarantee, once NIW is denied you can’t use the ead card. Now, if you want to be in the safe side you have to hold your current status till you hear the NIW decision. Can consult with your attorney to evaluate how strong is your profile to take your decision.
