case was recently reopened in Nov 2021, bcs spouse was just released from jail. prior to that, case as been administratively closed, but luckily I kept getting my EAD

so basically from the time case was reopened to now is 1 year

but the issue is that, there is no clear cut as to whether the case is truly open or not. Because initially when we requested for case to be reopened, my local field office declined, however 2 days after my local field office closed the case, NBC reopened it

why was the case closed ? have you gone for an interview? if you are the beneficiary your husband crime or going to jail should not affect your case or make it to be closed unless you are involved in the crime that caused your spouse to go to jail. Though I might be wrong but try to consult a reputable immigration attorney.

I don't think you can get a green card, because you are out of status. but not 100% sure
