Got tired from long wait for EB2 final action date
I have an approved I-140 EB2-NIW, with priority date of June 9, 2023.
My priority date has become current for filing in October 2024, and I filed I-485 and did biometrics and got my EAD card.
My priority date is still 2 months behind the final action date (Final Action date is April 1, 2023). Predictions say that the movement in the coming bulletins will be very little or there might be even retrogression.
Therefore, I’m thinking about filing I-140 EB1-A, which is current for filing and action for my country.
Any thoughts or advice on whether to wait for my turn for EB2 or file EB1-A?
Thanks

@mokhtar
If you believe you have a strong profile, have it reviewed by a lawyer as soon as possible. If you receive positive feedback from them and have the necessary resources, act quickly! No one knows what might happen with the EB1A program, so… if I had the funds, that’s definitely what I would do.
I’m waiting for my i140 (filed With one of the top law firms), since Nov 2023’.

@Kar NIW i140-Nov 2023’ Thanks so much for your input!
I’m just feeling guilty spending more money on filing EB1, but at the same time EB2 action date seems to be not promising.
Do you have idea on whether the EB2 action date will move significantly or not?
Thanks

@raza khan thnaks so much for your input. Hope things will move faster and I wouldn’t need to file EB1.

we may see little movement at the end of each quarter, that is for April/July.
I am very hopeful you will be current in one of these visa bulletin dates.

I agree with the April movement, but right now, things do not look promising.
Regarding the spending on the EB1A, if you can make it happen, I encourage you to go for it! As everyone here suggests, consult a good law firm to have your CV evaluated. If you receive positive feedback, then move quickly. Who knows? Maybe the EB1A will start the same NIW trend, and if you hesitate, you might miss the opportunity to apply and later regret it!
