Waiting for my Eb1B I-140 since Sept 2023
What has been the timelines for eb1b i-140 with regular processing from NSC for all of you here? My PD is current from a previously ported EB2 i-140. Is it worthwhile to go for PP since it’s already been 10.5 months? Should I just wait for another 4 weeks? Any suggestions?

I would suggest premium processing, if your sponsor is ok with it

@kay r my employer is okay with PP. But i am worried if that would increase the chances of RFE

i have sent in October too

@Dibya M, we are in the same situation. In fact, I suspect that your one of the cases that am tracking its progress alongside mine.
If it makes you feel better, I just PPed my application having waited for 10.5 months. Quite a pity but I just have to go this route.
About RFE, not sure the theory that once someone does a PP, the chance of RFE is increased is correct. I have colleagues who PPed and didnt get RFE.
So, go for it and worry less about RFE. If it comes, address it and get done with your petition.
Goodluck to us!

good luck! I filed mine last week with premium directly, had to take the risk given that my EB2 is current. hoping for a good result for everyone 🙂

thanks @Rijo Rijo and @Rohan R for sharing your experiences. Good luck to us!

@Dibya M I would say chances of RFE are low for EB1-2 if you have all your supporting evidence and lawyers did a good job. I think it’s more a worry for EB1-1.

@Dibya M chances are very low for rfe. max rfe they ask in eb1b is either tax documents or job offer from company. if your PD is current I would do PP. good luck

@Luke W gotcha, good luck! keep us posted! it would be good to know what USCIS does with the enquiries and how long they take! Good luck again and sorry for all that wait! i feel ya! 😅
Luke W2 de ago de 2024
@Dibya M thanks. next week I should be able to request the lawyer to submit the inquiry. but I've also heard people submitting that and getting no useful response for many weeks, so.. lets see
Dibya M5 de ago de 2024
pulled the trigger and requested for premium processing. @Rijo Rijo keep us posted in case you hear back anything. good luck to all of us! 😀

@Dibya M, good move.
Funny enough, my premium processing is still on going.....No correspondence. I wonder what USCIS is doing as it is almost the 15th day. WoW! I can't believe this.
Dibya M6 de ago de 2024
wow! whats going on i wonder? this is definitely not normal!
Luke W7 de ago de 2024
@Dibya M what is going on is simple: the number of applicants has been going up exponentially every quarter. the situation is exacerbated by the fact that most people go for premium right at the start, which means it is possible to overwhelm the limited number of immigration officers to the extent where they stop working on non premium cases altogether just to deal with premium (and the easier to adjudicate EB2/3 cases). that's why the estimated time to approval went from 4.5 months last August to 10 months now for 1B at NSC. this is likely to continue to increase.
as it happens, even my own immigration legal support's response time has gotten longer - too many new cases for them also! bad time to be an aspiring immigrant

And just checked today, USCIS has increased the processing time to now 10.5 months! 😭
