VAWA /Removal Proceedings
Hi Everyone , my I-130 and I-485 was denied in Jan2025 due to my partner non appearance as he was in jail. So i filled VAWA in March 2025 due to violence during our being together (still waiting for receipt)
Today I receievd a Notice to Appear for Removal proceeding in 2028. i had filled a new I-131and 756 with the VAWA petition . pls what to expect as my attorney said to wait till my VAWA receipt and Prima Facie is received .

Hello bro Joy Edward,
Firstly: you need to tell your lawyer to close your removal proceeding, after your vawa get approved then you are going to terminate your Asylum case.
Secondly: You cannot get I-131 because you're still in removal Proceeding.
Last one: Getting receipts is taking a lot of time , because of USCIS delay and no enough officers working on Vawa cases.

Thanks @Mark Douglas . am a lady . Do you know if I will get EAD since i filed concurently once I have my Prima Facie. Also , i guess my Current EAD is already nullified.

Hi Joy Edward, Yes you can get EAD if you applied with I-485 under your vawa.

I know this might sound scary, but no need to worry. You will receive your vawa receipt before your removal proceeding date and that will put a pause on your removal proceeding. Good luck.
