Yeah, the whole thing that sucks as I don't know what to do with my Immigration status.

You need to explain the case better. Immigration needs to see the cruelty you are facing, not the fact that you are suffering because the baby is not yours or because she cheated on you. I am sorry if I sound mean to you, but that’s the truth. Was she abusing you this whole time? You and her started having arguments and fights after what happened or it’s been doing on for a while? You will need more than that.

@Ishah I had similar car in 2019, I almost went made, immigration demanded DNA test, I personal wrote them and withdraw my case instead of denial, took me some time, I found an angel a beautiful woman, a blessing from God, we got married, I refilled. just got my authorization approved 1 week ago, my wife is currently pregnant we are both expecting baby. I hope you learn something from my experience.

@ishah. I think you have a good case for vawa. on what basis is your Noid on? we need to know if the NOID is worth fighting for or to proceed with vawa. let us know the content of your NOID.

@ishah you have a very very strong Vawa case. go for it. paternity fraud and infidelity is enough cause for mental stress and abuse and that’s a strong ground for vawa. whoever is telling to stay in that kind of marriage is delusional. i’ld say do vawa; it’ll give u time to reasses and live your life with freedom. No she did infedilty, but she claims she didn't know the child of not mine. Because we were also having a physical contact regularly during the time she convinced.

Overall, I want to work on making sure my immigration prospects in USA doesn't get permanent bar, for which I have to fight the NOID regardless of the outcome, and then after the decision, if I fail i will apply for Vawa petition.

Of course I would forgive her. She drank too much, was with the wrong people, and went too far. But it would almost certainly end the marriage. Forgiveness does not mean that the trust which underlies a marriage can be easily rebuilt, and being asked to trust again and to raise the child which came from her infidelity is an enormous and humiliating request.

@krish It looks like the actions of my wife can make me look like I have misrepresented my case infront of USCIS and now USCIS can claim that I have entered the marriage to evade immigration laws. The Odds are against me but my attorney says we should fight it Till Suprem Court but to do that I have to be married. Don't you think this is too much. And my attorney says Infedility on itself won't qualify Me for VAWA,

Fighting all the way threw Suprem Court is definitely an expensive path to pursue and on top of that I will not be eligible to work after i485 is denied I 130 is denied.

my case is denied now under BIA appeal based on uscis should focus on the intent at the time of marriage nit ehat happnes after the marriage.
