@Hadi R sometimes I think Attorneys don’t wanna take the responsibility of working on an RFE within a certain timeframe when they should be “cashing out” on other new cases. All my friends who switched to pp after a long wait had their cases approved and they’re currently gonna adjust their statuses. Think about this: if at the end of the long wait past your PD and you’re given an RFE, how long must you wait again for approval before advancing to the AoS step? Unless you’re not confident in your case, I’d recommend you go for pp.

@Eddie Kay The reason i hesitate is that I am not confident. When I was filing I was a phd student with 4 publications and 11 citations in the field of biomedical engineering. Now I am graduated with 6 publications and 42 citations. Currently postdoc fellow! What is the chance of denial?

@Hadi R Go for premium processing, it is really don’t increase tge chance of RFE and get it done. I have zero publications and het it done in three weeks with a well written petition relying on my experience in my field. Research profile is excellent when you are applying for EB2 NIW - doesn’t matter for EB1 -but it is not required for both as people believe. Think about of the significant wait time of you get rejection and lost you PD.

@Mr Dudu I was not a postdoc when I filed it, it’s not my fault that it took almost 2 years. Also, I do not believe that you can’t add another evidence or achivement!

@Mr Dudu As my understanding, RFE means Request for EVIDENCE!!!, does not mention new or old! When you propose a progress in your path, and your position, new evidences can support that what you have proposed going to the right direction or achievavle or not. New evidences can clarify more.

@Hadi R what @Mr Dudu is saying is very true. I’ve seen many top EB immigration lawyers post the same thing on LinkedIn several times. Only the evidence you started at the time of filing will be evaluated. If you add new information in an RFE, it is considered as a completely new filing by USCIS, and your case may be denied on that ground.

@Eddie Kay So new citations on previous publications, at time of filing, is not valuable to add? Just curious!

@Hadi R @Mr Dudu @Eddie Kay hey guys just wanted to add my two cents to this thread. I received an RFE in April 2025 for an application I submitted in Dec 2023. I added new evidence as part of my response (additional publications + citations, independent expert letters, speaking engagements, certifications). Submitted my response in June and got an approval less than 3 months later. I had also heard from others that USCIS doesn’t consider new evidence after the filing date but I’d like to think that wasn’t true in my case.
