SIS 485 and 765
EB-4 SIJS – I-485 & I-765 C09 pending / EAD expired – What else can I do?
Hi everyone, I’m looking for advice from anyone who has been in a similar situation.
I am an EB-4/SIJS applicant from Honduras. My priority date is December 20, 2021, and my I-360 has already been approved.
Here is my timeline:
* March 27, 2026: USCIS received my I-485 and I-765 (C09) package.
* May 15, 2026: Biometrics completed.
* My previous EAD C14 expired on October 3, 2026.
* My I-765 C09 is still pending.
* I depend on my employment authorization to work and support myself financially.
I have already tried several things:
* I requested an expedite request based on severe financial loss and provided/was prepared to provide evidence of my employment, pay stubs, financial obligations, bills, etc.
* USCIS indicated that an officer would contact me regarding the expedite/evidence, but I did not receive the expected follow-up.
* I contacted my Congressional representative, for assistance with my pending EAD case.
* A Congressional inquiry was submitted in early September 2026 (the congressional office later followed up around September 25, 2026). still no answer from uscis
* USCIS has still not provided a resolution on my pending I-765.
* I am now waiting for the 45-day period, which should be around October 18, 2026, before considering the next step with the CIS Ombudsman / DHS Form 7001.
At this point, my EAD has expired and my C09 EAD is still pending.
What else can I do at this point? Has anyone with EB-4/SIJS had success with a second expedite request, another Congressional inquiry, or the CIS Ombudsman after waiting 45 days?
I would really appreciate any advice or experiences. Thank you!

Hola a todos. Quisiera recibir consejos de personas que hayan pasado por una situación similar.
Soy solicitante EB-4/SIJS de Honduras. Mi fecha de prioridad es el 20 de diciembre de 2021 y mi I-360 ya fue aprobada.
Esta es mi línea de tiempo:
* 27 de marzo de 2026: USCIS recibió mi paquete de I-485 e I-765 (C09).
* 15 de mayo de 2026: completé las biometrías.
* Mi EAD C14 venció el 3 de octubre de 2026.
* Mi I-765 C09 continúa pendiente.
* Dependo de mi autorización de trabajo para poder trabajar y mantenerme económicamente.
Ya he intentado varias cosas:
* Solicité un expedite por pérdida financiera grave (severe financial loss) y preparé/proporcioné evidencia de mi empleo, talones de pago, obligaciones financieras, cuentas, etc.
* USCIS indicó que un oficial se comunicaría conmigo para el expedite/evidencia, pero no recibí el seguimiento esperado.
* Me comuniqué con mi congresista para solicitar ayuda con mi caso de EAD.
* La oficina del congresista presentó una congressional inquiry a principios de septiembre de 2026 y posteriormente hubo seguimiento alrededor del 25 de septiembre de 2026.
* USCIS todavía no ha resuelto mi I-765.
* Ahora estoy esperando que se cumplan los 45 días, aproximadamente el 18 de octubre de 2026, antes de considerar presentar el caso ante el CIS Ombudsman mediante el Formulario DHS-7001.
En este momento mi EAD ya venció y mi I-765 C09 continúa pendiente.
¿Qué más podría hacer en este punto? ¿Alguien con EB-4/SIJS ha tenido éxito haciendo un segundo expedite, otra congressional inquiry o contactando al CIS Ombudsman después de esperar los 45 días?

i’m in the same boat. I don’t know what else to do… I’m sorry. I heard back from the congressman and uscis just said “we understand the difficulties this may cause but we are unable to provide a timeframe for this case”.
I know how hard this is. I feel the pain. Hopefully we will get approval soon 🫂

@ally her Yes, I understand. It’s really frustrating to wait this long, especially when you depend on your work permit. I’ve seen cases where a Congressional Inquiry helped and the EAD was approved within 4–5 months. I’m just hoping it helps in my case too and that I get an update soon.

@Luis Perez try to get your driver license you can work with driver license dps send letter to uscis to aprove ur driver license it take like 3 weeks to get aprove but u need to renew your ead first you dont need to have it you just need to pay to renew it
