#SIJ GREEN CARD
MY PRIORITY DATE on my receipt(form I-797C) showing march 2023. My lawyer applied my green card near to that date. I got my biometrics appointment and its been 1.7 years now since that biometric update. Now i got a problem, My Lawyer is saying they rejected my green card because of priority date but i can’t able to see any rejection update on my status neither on this app nor on official website of USCIS and he is saying we have to apply it again when my priority date will be there and have to pay their fees again which is i think $1400 something because he is saying they didn’t refund the fees of $1225 i paid when i applied at first place So what you guys think, My lawyer is trying to steal more money or there could be something else. can someone please put some light on this. Thank you everyone in advance

I suggest you to contact USCIS. I know is hard to get a live agent, but you need to try. There must be an update stating that yout case was rejected and the reason why it was rejected. Another thing, if your PD was not current, your case will be denied but you cam apply again only when it becomes current. I’m not sure that you need to pay the fee again, that’s why you should contact USCIS.

did you waited the 3 year period and then apply? my bother applied as soon as he got his visa approved but they rejected the case and had to wait 3 year and apply again now he applied 1 1/2 ago and last week got his green card approved.

@Eduardo Martínez no my lawyer applied it as soon as my i360 got approved and i paid the fees too. That time it used to be $1225 then after couple months later they increased their fees

me olso I got rejected because pio date is not available when I sended my green card that's why I got rejected

I don't think your lawyer is trying to take your money, but it was a mistake for him to file your Adjustment of Status (AOS) knowing your priority date wasn’t current. As a lawyer, he should have been aware of this. You’ll need to wait and monitor the Department of State Visa Bulletin each month until your priority date becomes current. Only after that, you can file your AOS.

@N G You’re right. I had to repeat the medical examination three times becuase my lawyers committed several mistakes while filing. Unfortunately, I had to pay $350 each time.

@N G hey thank you for the advice. And other thing as I don’t completely know how to see visa bulletin so as of right now its showing august1, 2019, so i have to wait until it will show march 2023??

Where are you from? I also applied for mine in March 2023 and my case was paused due to the priority date not being available, they even requested my medicals but I know they didn't request everyone. I'm from Brazil. I don't know if this applies to all countries but at least Brazilians were able to apply for the green card until March 9, 2023... after that they weren't allowing anyone else, now people have to wait until the priority date is available and apply for it. USCIS received my application on March 7, 2023 so they received my application and worked on it but they can't send me the gc due to the backlog I know it’s weird and frustrating so all we can do is pray right now :/

@g f im from india, and yeah in my case as well that time they was applying the green card but couple months later they stopped applying for anyone else. now i am hearing from many people that you can’t able to apply for that until your priority date is current. TBH i don’t know what my lawyer did but something is not connecting. i asked uscis they are saying we have your I485 application but you have to wait and then apply for it, now i don’t know if having application is one thing and apply for it is another or both are same. God knows!!!
