Should I consider mandamus?
Hello everyone Im here for a advice… I applied for my I485: October 5-2023 Fingerprints taken : July 23-2024 USCIS received my RFE (Medical exam) on September 15-2024 and that was the last update until I got the one of the FBI My question is: Its been 36 months since I applied for my green card and still pending Should I do the Mandamus? or it will be risky? I feel like I been waiting too long now (I got my asylum granted on february 2021) But i couldn’t applied a year later so life circumstances allowed me to do it until 2023 Any similar situation?

Hi sister we are in very bad times right now application are moving very slow and majority of people whom I am seeing get approved filed Mandamus it all comes to personal decision..... The lawyers I spoke with said after 12 months a person can file and you way above this timeline. I hope you get very good news soonm

@Johana Deodanes yes iam the same I apply mine and my daughters in October 6-2023 and in January 2025 they update to casa is ready to schedule an interview and still waiting my attorney say that I must wait I send a inquiry about 4 months I hope we got good news soon good luck

with 36 months you can and should file an inquiry with USCIS, file a congressional inquiry, and if they both fail to move the case definitely mandamus then

since you're over the average processing time, you can ask your lawyer to send a letter inquiry requesting an adjudication immediately and if that doesn't work, file a mandamus. you should get approved immediately

the current proccing times are 34 months, as @One Applicant said definitely do a USCIS inquiry first
