Don't worry about being out of status. The most important thing is that your marriage is real. You'll be approved.

I’ve been reading a lot of cases on Facebook and here. does being out of status case take much longer?

I was out of status. Case took 4 months 3 weeks.

and also they will request RFE for i485! some people even got asked to send school transcripts even when they graduated long time ago. those people got out of status after studying a bit

omg really? did they ask you RFE? what visa were you on?

I wouldn't worry too much about this. I didn't get an RFE. No question about school at all (was on F1 before going out of status) If you send a good application and show that your marriage is real, all those questions will be irrelevant.

No the officer didn't ask. She just confirmed the school I attended.

my friends told me I am worried too much but since I had to wait for f1 for a looong time. i get scared this time. i do have a lot of evidence about our relationship. we’ve been dating for 2.5 years

And do use a lawyer just so you don't make unnecessary mistakes

out of status is forgiven for spouses of us citizens

by being married to a us citizen, your unlawful presence gets forgiven, since you are a immediate relative of a us citizen

there really isn’t anything to worry about since you are married to a US citizen and your paperwork & supporting documents are phenomenal. I’m also in a similar situation, F1 out of status, married to a US citizen and did not use a lawyer.

Nothing to worry but apply to the J1 waiver before submitting your AOS.

i came here as an Aupair so my j1 is not subjected to two year. I don’t think I have to apply to the J1 waiver
