Notice of intent to rescind
My Employment based GC was approved 11 days after the dates retrogressed and I received Notice of intent to rescind after 1 year. My attorney responded to the Noir but there is no further communication from uscis and its already 15 months

their argument is the Visa number was issued when visas were not available for my Priority date

I was current till Sept 30 2022 and from Oct 1st dates retrogressed… my 485 was approved on 11th Oct 2022 … so basically I was not current

Wow! they should have let that go! when was the priority date for that month released? could that be the reason?

did you try calling or chatting with them? it sounds like they might have been ok with the response and closed the case.

@Johnson Control the Visa bulletin for oct was released by mid sept … but as per USCIS guidelines the LPR can be adjudicated only till the month end when the dates are current

@m t called multiple time , the. case is still open … have started a ombudsman request
