so seems it should be within 90 days

dnt know. I really don't know what they are doing.i think they are busy with i485 adjudication to reach this fiscal years data I don't think they will touch rfes before. 30th September

I read in different forums that no more available visa for eb1/eb2 for this fiscal year, till Sep 30.. that could be the reason of the delay

I don't think so. the visa unavailability is related to I485. I140 is not related to visa availability.
